新农村建设中公众参与问题研究

【摘要】：高效有序的公众参是国家民主法治健全与否的集中体现。2014《中共中央关于全面推进依法治国若干重大问题的决定》中指出,依法治国的重要任务包含增强全民法治观念,推进社会法治建设。而尊重和保障人权是社会主义法治的基本原则。在新农村建设过程中广泛的推进公众参与,能够保障新农村建设中公民的基本民主权利,是表达农民诉求的有效途径,能够推进新农村建设过程中民主法治工作的进程,体现了依法治国的重要要求。以往在关于推进公众参与的相关研究中,焦点主要集中全国整体范围的公众参与,缺乏针对农村领域推进公众参与的研究,关于公众参与问题的研究集中于宏观意识方面与制度、途径方面,缺乏具体问题分析如以往的研究只是把公众参与作为一项参与活动缺乏对参与主体的具体划分,没有研究各类参与主体存在的不同问题,而得出的一般普遍结论为公众参与在中国存在门槛过高、参与信息不健全、参与渠道缺失等问题。本文在科学调研的基础上主要要采用问卷调查与访谈的研究方法,针对安徽省在新农村建设中的公众参与问题进行研究并形成论文。在调研与写作过程中,结合相关学者的研究成果,在研究新农村建设中存在一般问题的基础上,重点寻找新农村建设中公众参与主体存在的问题,并集中分析新农村建设中农民参与主体的参与问题,研究认为新农村建设中产生的公众参与问题主要有农民主体文化素质低参与意识淡薄、农民经济合作社缺乏有效管理机制无法反应参与诉求、政府对待农民参与的重视程度尚待提高、法律上缺乏对农村公众参与的保障等。本文从参与主体的意识形态、新农村建设的参与形式与途径内容等方面进行思考,结合调研结果得出结论安徽省新农村建设中公众参与工作有待发展完善,解决新农村建设中的公众参与问题需要农民参与主体、政府保障、社会志愿者团体的共同协作。
[Abstract]:An efficient and orderly public consultation is a concentrated embodiment of the sound or not democratic rule of law in the country. In the decision of the CPC Central Committee on comprehensively promoting the Rule of Law in an All-round way, it is pointed out that the important task of administering the country according to law includes strengthening the concept of the rule of law by the whole people. We will promote the construction of social rule of law. And respecting and safeguarding human rights is the basic principle of socialist rule of law. To promote public participation in the process of new rural construction can guarantee the basic democratic rights of citizens in the construction of new countryside, is an effective way to express farmers' demands, and can promote the process of democratic and legal work in the process of new rural construction. It embodies the important requirements of governing the country according to law. In the past, in the related research on promoting public participation, the focus is mainly on the overall national public participation, and there is a lack of research on promoting public participation in rural areas. The research on public participation is focused on the macroscopic consciousness and the system, the way, the lack of concrete problem analysis, for example, the previous research only regards the public participation as a participation activity and lacks the concrete division of the participants. The general conclusion is that the threshold of public participation in China is too high, the participation information is not perfect, the participation channel is missing and so on. On the basis of scientific investigation, this paper mainly adopts the method of questionnaire and interview to study the problem of public participation in the construction of new countryside in Anhui province and form a thesis. In the process of investigation and writing, combined with the research results of relevant scholars, on the basis of studying the general problems in the construction of new countryside, we focus on finding the problems of the main body of public participation in the construction of new countryside. And focus on the analysis of the participation of farmers in the construction of new rural areas, the study shows that the main problems of public participation in the construction of new rural areas are the low participation consciousness of farmers' main cultural quality. The lack of effective management mechanism of farmers' economic cooperatives can not reflect the demands of participation, the government should pay more attention to farmers' participation, and the law lacks the protection of rural public participation. This paper thinks about the ideology of the participants, the forms and ways of the new rural construction, and draws the conclusion that the public participation in the construction of the new countryside in Anhui Province needs to be developed and perfected. Solving the problem of public participation in the construction of new countryside requires the cooperation of farmers' participation main body, government guarantee and social volunteer group.
