社会角色理论视野下的人大代表角色冲突与角色调适研究

【摘要】：人大代表,作为我国人民代表大会的组成人员,是人民意志的表达者与利益的捍卫者,在国家体制内具有崇高的政治地位。本文以社会角色理论为研究视野对人大代表的角色进行整体透视,主要从三个部分进行论述:第一部分,先对代表理论与社会角色理论进行梳理,再将两者进行耦合,分析人大代表的角色归属、角色权利、角色义务、角色类型和角色功能。从法律文本来看,人大代表本质上是一项政治职务,具有主体性、代表性、责任性与政治性的特征;从角色归属来看,可从强制委托模式、独立代表模式和集中代表模式这三种模式来理解人大代表的复杂内涵;从角色权利与角色义务来看,人大代表具有"七权七责";从角色类型来看,可从期待角色、领悟角色和实践角色去理解类型的多元化;从角色功能来看,人大代表具有参政议政、依法监督、桥梁纽带和模范带头的功能。第二部分,分析人大代表角色冲突的冲突表现及冲突缘由。人大代表在进行角色扮演时,常陷入角色外冲突、角色内冲突和角色间冲突这三种冲突,其本质上是公共利益与私人利益、整体利益与局部利益的冲突,这种冲突的缘由来自于社会、他人和个人这三个方面。第三部分,针对这些角色冲突提出角色调适。可从个人维度进行角色塑造,以提高人大代表们的政治素质、道德素质、业务素质、身体素质和心理素质;从社会维度出发,通过制定角色规范、强化角色意识、组织角色学习、进行角色监督和探索角色专职来进行角色建设。
[Abstract]:Deputies to the National people's Congress, as members of the people's Congress of our country, are the expression of the will of the people and the defenders of interests, and have a high political status in the state system. This article takes the social role theory as the research visual field to carry on the overall perspective to the people's Congress representative's role, mainly carries on the discussion from three parts: the first part, carries on the comb to the representative theory and the social role theory, then carries on the coupling between the two. Analyze the people's Congress's role ownership, role rights, role obligations, role types and role functions. Judging from the legal text, the deputies to the people's Congress are essentially a political post with the characteristics of subjectivity, representativeness, responsibility and politics, and from the perspective of role attribution, it can be seen from the mode of compulsory entrustment. The independent representative model and the centralized representative model are the three models to understand the complicated connotation of the NPC deputies; from the perspective of the roles, rights and obligations, the NPC deputies have "seven powers and seven responsibilities"; from the role type, we can look at the expected role. From the perspective of role functions, deputies to the people's Congress have the functions of participating in government affairs, exercising supervision according to law, bridge ties and exemplary leadership. The second part analyzes the conflict performance and causes of the role conflict of the NPC deputies. When the deputies to the people's Congress play their roles, they often fall into three kinds of conflicts, which are external conflicts, intra-role conflicts and inter-role conflicts, which are essentially conflicts between public and private interests, and between the overall interests and the local interests. The causes of this conflict come from the three aspects of society, others and individuals. The third part, aiming at these role conflicts, puts forward the role adjustment. In order to improve the people's Congress deputies' political quality, moral quality, professional quality, physical quality and psychological quality, from the perspective of social dimension, the role consciousness can be strengthened through the formulation of role norms. Organize role learning, role supervision and role-specific role-building.
