温州市女性农民工权益保障问题研究

【摘要】：农民工的权益保障问题一直是学界和社会关注的焦点。近年来,随着国内经济实力的不断提高,人民生活质量也普遍得到显著提高。但农民工这一庞大群体,在受益的同时,由于自身因素的限制、制度的不够完善,他们的权益得不到全面保障,尤其是女性农民工,他们体力不如男性,又因家庭、生育等原因在就业中遭受不平等待遇,生存空间小,生存压力大,亟需全社会给予关注。从长远上看,妥善解决好女性农民工的问题也是贯彻以人为本理念的重要实践,只有真正抓好农民工生存环境改善这一社会问题或者说民生问题,才能更好的遏制城乡差距,社会才会更加和谐稳定。因此,对女性农民工的研究具有非常特别的社会意义。本文在分析国内外关于女性农民工研究的相关观点和研究成果基础上,以跨地域流动的女性农民工为研究对象,以温州市外来务工人员的女性打工者作为研究对象,采取查阅参考文献、现场走访、填写问卷和面对面采访等多种形式展开调研并对样本进行分析,归纳出温州市在女性农民工权益保障方面的经验和不足,分析温州市女性农民工权益缺失现状及原因解释,最后总结出完善温州市女性农民工权益保障的对策,以期给全国其他农民工聚集地区提供示范作用,以此来推动我国城市化的发展和现代化的早日实现。文章从五个方面对农民工权益保护问题展开论述。第一部分是绪论,简明地对当前女性农民工权益保障所处的社会环境进行了描述,并确定了样本抽取办法;第二部分则围绕女性农民工权益保障话题从理论方面进行了全面细致的阐述;第三部分以温州市为例进行了案例剖析,介绍了温州市在女性农民工权益保护方面的主要做法和成功经验;第四部分对女性农民工权益缺失的表现及产生这些缺失的成因进行了分析;最后一部分针对温州市在女性农民工权益保障方面存在的问题,提出了一些改进意见和应对措施。包括女性农民工应加强教育和培训,提升自身素质,学习法律知识,提高维权意识;规范用工行为,构建组织化维权机制;同时政府应完善相关法律法规,加强执法力度。
[Abstract]:The protection of the rights and interests of migrant workers has always been the focus of academic and social attention. In recent years, with the continuous improvement of domestic economic strength, the quality of life of the people has been significantly improved. However, while benefiting from the huge group of migrant workers, because of the limitations of their own factors and the imperfection of the system, their rights and interests are not fully safeguarded. Especially for women migrant workers, they are not as physically as male, but also because of their families. Birth and other reasons suffer from unequal treatment in employment, small living space, great pressure of survival, and need the attention of the whole society. In the long run, a proper solution to the problem of female migrant workers is also an important practice of carrying out the people-oriented concept. Only when we really grasp the social problem of improving the living environment of migrant workers or people's livelihood can we better curb the gap between urban and rural areas. Society will be more harmonious and stable. Therefore, the study of female migrant workers has a very special social significance. Based on the analysis of the domestic and foreign research on female migrant workers, this paper takes the female migrant workers from different regions as the research objects, and takes the migrant workers of Wenzhou as the research objects. By consulting references, on-the-spot visits, filling out questionnaires and face-to-face interviews, and analyzing the samples, we conclude the experiences and shortcomings of Wenzhou City in the protection of the rights and interests of women migrant workers. This paper analyzes the present situation of female migrant workers' rights and interests in Wenzhou and their reasons, and finally summarizes the countermeasures to improve the protection of the rights and interests of women migrant workers in Wenzhou, with a view to providing an example for other migrant workers' gathering areas in the country. In order to promote the development of China's urbanization and the early realization of modernization. This paper discusses the protection of the rights and interests of migrant workers from five aspects. The first part is the introduction, which briefly describes the social environment of the protection of the rights and interests of women migrant workers, and determines the method of sampling; The second part focuses on the topic of the protection of the rights and interests of women migrant workers from the theoretical aspects of a comprehensive and detailed elaboration; the third part of Wenzhou City as an example of the case analysis, This paper introduces the main methods and successful experiences of the protection of the rights and interests of female migrant workers in Wenzhou. The fourth part analyzes the expression of the lack of the rights and interests of the female migrant workers and the causes of these deficiencies. In the last part, some suggestions and countermeasures are put forward for the protection of the rights and interests of female migrant workers in Wenzhou. Including female migrant workers should strengthen education and training, improve their own quality, learn legal knowledge, improve awareness of safeguarding rights; standardize employment behavior, build a systematic mechanism; at the same time, the government should improve relevant laws and regulations, strengthen law enforcement.
