德国财产权确立及其社会义务之启示

【摘要】：表面上物或者权利所有者可以按照自己的意愿对物或权利进行支配和使用,事实上每个人在对物与权利进行支配和使用时均需要遵守法律法规,并承担社会义务。如何界定公民私有财产应当无偿承担社会义务的界限,则是财产权保障需要解决的问题。只有明确财产权利和义务之关系才能促进财产权的保障。
[Abstract]:On the surface, the owner of things or rights can control and use things or rights according to his own wishes. In fact, everyone should abide by laws and regulations and undertake social obligations when controlling and using things and rights. How to define the limits of civil private property should bear social obligations without compensation is a problem that needs to be solved in the protection of property rights. Only by clarifying the relationship between property rights and obligations can we promote the protection of property rights.
