法国行政分权视阈中的地方公共团体研究

【摘要】：法国地方分权制度经过近30年的发展,地方自治得到了确认,地方民主也获得了发展。法国地方分权的发展不但关系到法律基本制度的建设,如公法人制度的建立和以法律形式明确各个权限的分配,而且涉及机构的独立化、普遍选举的推动以及公务法人的多样化发展和合理分类,还涉及建立必要合理的监督手段使地方的积极性在中央的监控下良性有序地发挥。对地方公共团体概念的把握是了解法国地方分权制度的关键。
[Abstract]:After nearly 30 years of development, local autonomy has been confirmed and local democracy has been developed in France. The development of decentralization in France is not only related to the construction of the basic legal system, such as the establishment of the system of public legal persons and the clear distribution of each jurisdiction in the form of law, but also involves the independence of the institutions. The promotion of general election and the diversified development and reasonable classification of public legal persons also involve the establishment of necessary and reasonable means of supervision so that the enthusiasm of the local authorities can be brought into play in a benign and orderly manner under the supervision of the central authorities. To grasp the concept of local public organization is the key to understand the system of decentralization in France.
