【摘要】：《黑格尔法哲学批判》是马克思于1843年写下的一部未完成的法哲学著作手稿,该手稿于1927年才得以发表。它是马克思针对黑格尔《法哲学原理》阐述国家问题的部分所作的批判性分析,其写作始于马克思自己"困恼的疑问"。马克思在批判黑格尔的基础上,第一次较为全面地阐述了其法哲学观点:不是国家与法决定市民社会,而是市民社会决定国家与法;不是君主主权,而是人民主权;民主制中不是人为法律而存在,而是法律为人而存在。该作品中历史唯物主义的思想开始萌芽,它是马克思世界观转变历程中的一部重要作品,是马克思主义法学的真正发源地。
[Abstract]:Criticism of Hegel's philosophy of Law is an unfinished manuscript of philosophy of law written by Marx in 1843, which was published in 1927.It is Marx's critical analysis of the part of Hegel's philosophy of Law explaining the problems of the state, and its writing begins with Marx's own "perplexing questions".Marx, on the basis of criticizing Hegel, for the first time fully expounded his philosophy of law: it is not the state and the law that determine the civil society, but the civil society that determines the state and the law, not the sovereignty of the monarchy, but the sovereignty of the people.Democracy does not exist for law, but law for man.The thought of historical materialism in this work has begun to sprout. It is an important work in the course of the transformation of Marx's world outlook and the real birthplace of Marxist jurisprudence.
