论传统“德主刑辅”思想对和谐社会构建的启示

【摘要】：和谐社会是中国共产党、中国政府和中国人民的共同理想与追求。儒家一直推崇的“德主刑辅”治国理念在中国历史上又占据着极为重要的地位，由此本文的研究通过对历史变迁中“德主刑辅”治国理念的阐释，及对现实生活中所出现的难以解决的道德和法律问题的探究，从而分析出当下我国的治国理念中所存在的问题与不足，并提出理论上的解决方法和实践中的具体实施方略。本文以“德主刑辅”思想为逻辑起点贯穿全文始终。按历史发展更迭的纵向递进和当下我国的现实情况，，本文采取了伞状研究方法，一是点和线，通过对“德主刑辅”思想的历史分析而率先分析出其合理性与局限性，以便总结出更为严谨的思想内容，为以后的治国理念设想提供材料；二是面，对现实社会中比较典型的而又影响面广的社会问题进行阐述，为后文做现实铺垫，通过理论和现实的分析之后总结出这一思想对我国治国方面的启示意义，由“德主刑辅”思想到“德治”与“法治”的辨析，最后引出解决的方法——德法兼治，并提出具体的措施与在实践中所要注意的问题。
[Abstract]:Harmonious society is the common ideal and pursuit of the Communist Party of China, the Chinese government and the Chinese people. The concept of "morality dominating punishment and auxiliary punishment", which has always been respected by Confucianism, occupies an extremely important position in Chinese history. Therefore, the study of this paper is based on the explanation of the concept of "morality dominating punishment and auxiliary punishment" in the historical vicissitude. This paper probes into the difficult moral and legal problems in real life, and then analyzes the problems and shortcomings existing in the concept of governing the country in our country, and puts forward the theoretical solutions and the concrete implementation strategies in practice. The logical starting point of this thesis is the thought of "virtue as the chief punishment and auxiliary punishment" throughout the whole text. According to the vertical progression of historical development and the current reality of our country, this paper adopts the umbrella-shaped research method, one is the point and the line, through the historical analysis of the thought of "virtue dominates punishment auxiliary" and first analyzes its rationality and limitation. In order to sum up more rigorous ideological content, to provide materials for future ideas of governing the country; second, to elaborate on the more typical and widespread social problems in the real society, so as to pave the way for the following articles. Through the analysis of theory and reality, this paper sums up the enlightening significance of this thought to our country, from the thought of "morality dominates punishment auxiliary" to "rule by virtue" and "rule by law", and finally leads to the method of solving it, which is the combination of morality and law. And puts forward the concrete measure and the question which should pay attention in the practice.
