马克思主义人权思想中国化研究

【摘要】：马克思主义人权思想的中国化,就是在坚持马克思主义人权思想的基础上将其正确地应用于中国的人权实践,并不断将人权实践的经验升华为人权理论,以新的人权理论丰富马克思主义人权思想的内容。 本文在内容上主要分为四个部分： 第一部分论述了马克思主义经典作家人权思想的主要内容。马克思主义经典作家认为,人权不是天赋的,而是社会历史的产物,人权总是受到一定的社会经济、政治、文化等各种因素的制约,集体是人权得以实现的根本保障,人类的彻底解放是实现普遍人权的根本途径。 第二部分从马克思主义中国化的学科视角梳理马克思主义人权思想中国化的发展脉络,认为马克思主义人权思想的中国化是一个不断演进的过程。马克思主义人权思想中国化的演进历程与中国人权事业的实践发展历程具有逻辑层次上的一致性,这种逻辑层次可以概括为：以社会主义革命和政权建设确立民族独立权和人民民主自由权、以经济发展保障和提高人民生存权与发展权、以宪法人权原则尊重和保障人权、以“国家人权行动计划”推进人权等 第三部分从马克思主义中国化的学科视角探讨了中国共产党对马克思主义人权思想的理论创新。中国共产党在马克思主义人权思想的基础上,创造性地提出,国家独立权是人权的根本前提,中国共产党的领导是实现中国人权的根本保证；并将尊重和保障人权提升为治国理政的重要原则,在国际政治经济新秩序中倡导确立平等、无差别化人权理念等。 第四部分分析了马克思主义人权思想中国化对我国的人权事业建设的重要启迪：充分挖掘和科学理解马克思主义人权思想的理论资源,走适合中国国情的人权发展道路,坚持马克思主义人权思想的与时俱进,加强国内人权事业和国际人权事业的互动。 对马克思主义人权思想的中国化问题进行深入研究,有助于我们更加系统地、全面地把握中国化的马克思主义人权思想及其精髓,同时也有助于把握马克思主义人权思想中国化的发展方向,以发挥其对我国未来人权事业发展的重要指导意义。
[Abstract]:The Sinicization of Marxist human rights thought is to correctly apply it to China's human rights practice on the basis of adhering to Marxist human rights thought, and constantly sublimate the experience of human rights practice into human rights theory. Enrich the content of Marxist human rights with the new theory of human rights. The content of this paper is divided into four parts: the first part discusses the main contents of Marxist classic writers' human rights thought. Marxist classical writers believe that human rights are not natural, but a product of social history, that human rights are always restricted by certain social, economic, political, cultural and other factors, and that the collective is the fundamental guarantee for the realization of human rights. The complete liberation of mankind is the fundamental way to realize universal human rights. The second part combs the development of Marxist human rights thought in China from the perspective of Marxism in China, and thinks that the Sinicization of Marxist human rights thought is a process of continuous evolution. The evolution of Marxist human rights thought in China is consistent with the practical development of China's human rights cause at the logical level. This logic can be summarized as follows: the establishment of the right to national independence and people's democratic freedom through socialist revolution and regime building, the guarantee and improvement of the people's right to subsistence and development through economic development, and the respect and protection of human rights in accordance with the principles of constitutional human rights, In the third part of "National Human Rights Action Plan" to promote human rights, the author discusses the theoretical innovation of Marxist human rights thought from the perspective of Marxism in China. On the basis of Marxist thought of human rights, the Communist Party of China creatively puts forward that the right of national independence is the fundamental premise of human rights, and the leadership of the Communist Party of China is the fundamental guarantee of the realization of human rights in China. It also promotes respect and protection of human rights as an important principle of governing and governing, advocates the establishment of equality in the new international political and economic order, and does not differentiate the concept of human rights. The fourth part analyzes the important enlightenment of the Sinicization of Marxist human rights thought to the construction of human rights in China: fully excavating and scientifically understanding the theoretical resources of Marxist human rights thought, and taking the path of human rights development suitable for China's national conditions. Adhere to Marxist human rights thinking with the times, and strengthen the interaction between domestic and international human rights undertakings. An in-depth study of the Sinicization of Marxist human rights thoughts will help us to grasp more systematically and comprehensively the Marxist human rights thinking and its essence. At the same time, it is helpful to grasp the development direction of Marxist human rights thought in China, so as to give play to its important guiding significance for the future development of human rights in our country.
