中国共产党依法执政问题研究

【摘要】：“法治”是现代国家治理的基本方式,是现代国家文明的标志。中国共产党是中国的执政党,党的领导方式和执政方式科学与否决定党的领导水平、执政能力,关系着党与人民群众的联系和执政地位的巩固。正因如此,党的依法执政是坚持依法治国的关键。依法执政解决的是执政党与国家政权的关系。依法执政既是对历史经验教训的深刻总结,也是对中国特色社会主义历史必由之路的深刻认识,对全面推进我国法治国家建设具有决定性的作用。依法执政作为一种执政方式是中国共产党在第十六次党的全国代表大会上正式提出的。依法执政经历过中国发展的几个阶段,在中国共产党依法执政的过程中取得了巨大的成就,迎接了巨大的挑战。但是我国目前处于改革发展的深水区,中国共产党的依法执政在新的时期面临着新的问题和挑战。法律法规的不完善、依法执政在执行中的缺失、党的干部依法执政的观念薄弱、党政关系有待进一步的理顺等问题,以及面临新的时代国内外形势变化所带来的挑战。要解决这些问题,应对这些挑战,就必须通过完善法律体系、理顺党政关系、加强党依法执政的思想建设以及借助具有时代性的方式来助推中国共产党的依法执政,这样才能进一步完善党的执政方式,提高党的执政能力,在中国共产党的正确领导下,把我国建设成民主、富强、文明的强国。
[Abstract]:Rule by law "is the basic way of modern state governance and the symbol of modern national civilization." The Communist Party of China is the ruling party of China. Whether the Party's leading style and ruling mode are scientific or not determines the Party's leading level and ruling ability, which is related to the relationship between the Party and the masses of the people and the consolidation of the ruling position. Therefore, the Party's ruling by law is the key to uphold the rule of law. Ruling by law is the relationship between the ruling party and the state power. Ruling by law is not only a profound summary of historical experience and lessons, but also a profound understanding of the only way of socialism with Chinese characteristics, which plays a decisive role in promoting the construction of our country ruled by law in an all-round way. Ruling by law as a ruling way was formally put forward by the Communist Party of China at the 16th National Congress of the Party. Ruling by law has experienced several stages of China's development, and has made great achievements and met enormous challenges in the process of ruling by law of the Communist Party of China. However, China is now in the deep water area of reform and development, and the ruling by law of the Communist Party of China is facing new problems and challenges in the new period. The imperfection of laws and regulations, the lack of ruling by law in execution, the weak concept of Party cadres ruling according to law, the need to further straighten out the relationship between the Party and the government, and the challenges brought by the changes of the situation at home and abroad in the new era. In order to solve these problems and meet these challenges, we must improve the legal system, straighten out the relationship between the party and government, strengthen the ideological construction of the Party to govern according to law, and help the Communist Party of China to take power according to the law by means of the methods of the times. Only in this way can we further perfect the ruling way of the Party, improve the ruling ability of the Party, and build our country into a democratic, prosperous and civilized country under the correct leadership of the CPC.
