论打破“救人反被诬陷”怪圈的法律方法

【摘要】：自从"南京彭宇案"之后,各种扶老人被讹事件的报道层出不穷,屡见报端和互联网。本文针对此问题,从被扶老人屡屡讹诈救助者的原因分析入手、深入地探讨,提出了"加大对诬陷者的处罚力度"、"坚持公正司法","坚持公正司法,提高司法公信力"以及"完善我国社会保障法律制度"三个方面提出解决的法律方法。
[Abstract]:Since the case of Peng Yu in Nanjing, there have been numerous reports of the false incidents of helping the elderly, often seen in newspapers and on the Internet. This article, in view of this problem, begins with the analysis of the reasons why the elderly have repeatedly blackmailed rescuers, and probes deeply into this issue. The author puts forward three legal methods to solve the problems, such as "increasing the punishment of framing criminals", "insisting on just judicature", "insisting on just judicature, improving judicial credibility" and "perfecting our country's social security legal system".
