基于权益保障的南京市宅基地房屋拆迁问题研究

【摘要】：改革开放以来,我国经济迅猛发展,综合国力极大提升,其中,城镇化是主要动因。随着城镇化的深入推进,征地拆迁成为热议话题,被打上了"不满、摩擦、冲突"等时代标签,无形中被推上了众矢之的的风口浪尖,现阶段更成为与劳资纠纷和社会保障纠纷并提的三大社会矛盾之一,特别是其中事关亿万农村人口的宅基地房屋拆迁问题,处理起来最为复杂,对应的社会关注度也最高。因此,妥善处理好宅基地房屋拆迁所涉及的各类矛盾是现阶段需要重点攻克的难题。第一部分是论文的绪论部分。该部分作为文章的纲目,对论文的选题背景、研究意义、国内和国外研究现状、研究方法、技术路线及创新与不足等逐一阐述。第二部分是论文的研究理论基础。对涉及的相关概念进行解读,重点阐述风险社会理论、社会治理理论、社会保障理论、博弈论等研究所涉及的理论依据。第三部分是结合权益保障对南京市宅基地房屋拆迁相关政策的历史做深入分析。首先,阐述历年来南京市征收集体土地涉及房屋的拆迁政策及其变化;其次,通过理论分析与数据比较,论述多轮政策调整后现阶段权益保障的相关情况。第四部分是宅基地房屋拆迁问题的权益保障分析。一是进行实地调研并对座谈记录做归纳总结,分析存在的普遍问题,重点阐述未征先拆现象;二是就拆迁问题中的补偿环节做专项研究,通过江心洲地块个案的剖析,对补偿现状的不足症结进行提炼,并对特殊问题撤组剩余国有地块补偿政策适用合理性问题展开论述;最后,以权益保障为切入点就其中存在的主要问题及内在矛盾做深入分析。第五部分是解决宅基地房屋拆迁问题的对策建议。具体解决路径主要是从拆迁立法、市场评估、可持续性保障、体制革新及自主自治四个方面加以综合考虑。第六部分是论文的结论部分。对论文的研究内容进行总结。宅基地房屋拆迁问题是城镇化建设所必须面对的现实问题和长远规划,处理失当甚至将影响社会稳定和政治安定大局。以此为研究,一方面希望通过理论分析、数据分析结合实地调研的方式,深入挖潜宅基地房屋拆迁冲突产生的内因并探索解决路径。另一方面也是为了能够对拆迁操作实务的导向有所启发和引领。
[Abstract]:Since the reform and opening up, China's rapid economic development, comprehensive national strength is greatly improved, among which, urbanization is the main motivation. With the further development of urbanization, land requisition and relocation has become a hot topic, labeled "discontent, friction, conflict" and so on. At the present stage, it has become one of the three social contradictions with labor disputes and social security disputes, especially the problem of house demolition and relocation involving hundreds of millions of rural population, which is the most complex to deal with, and the corresponding social attention is the highest. Therefore, properly handling all kinds of contradictions involved in the demolition of homestead houses is a difficult problem that needs to be solved at this stage. The first part is the introduction of the paper. This part, as the outline of the article, expounds the background, significance, domestic and foreign research status, research methods, technical route, innovation and deficiency of the thesis. The second part is the theoretical basis of the thesis. The related concepts are interpreted, and the theoretical basis of risk society theory, social governance theory, social security theory, game theory and so on are expounded. The third part is an in-depth analysis of the history of housing demolition and relocation policies in Nanjing in combination with the protection of rights and interests. First of all, this paper expounds the demolition policy and its changes of the collective land expropriation in Nanjing over the years. Secondly, through theoretical analysis and data comparison, this paper discusses the relevant situation of the protection of rights and interests at the present stage after the multi-round policy adjustment. The fourth part is the homestead house demolition rights and interests protection analysis. The first is to carry on the field investigation and summarize the record of the discussion, analyze the existing general problems, and focus on the phenomenon of uncollected and first removed; The second is to do special research on compensation link in demolition and relocation, through the analysis of Jiangxinzhou land block case, to refine the deficiency of the compensation status, and to discuss the rationality of the compensation policy of the special problem to be withdrawn from the remaining state-owned land; Finally, the paper analyzes the main problems and internal contradictions from the point of view of the protection of rights and interests. The fifth part is to solve the homestead house demolition problem countermeasure suggestion. The concrete solution is mainly considered from four aspects: relocation legislation, market evaluation, sustainability guarantee, institutional innovation and autonomous autonomy. The sixth part is the conclusion of the paper. The research content of this paper is summarized. The problem of house demolition and relocation is a realistic problem and long-term planning that must be faced in the construction of urbanization. Improper handling will even affect the overall situation of social stability and political stability. On the one hand, it is hoped that through theoretical analysis, data analysis and field investigation, the paper will explore the internal causes of house demolition conflicts and explore the solutions. On the other hand, it is also in order to be able to open the practice of practical guidance and guidance.
