农村土地流转中的利益冲突及其协调机制研究

【摘要】：合理的流转土地极大的提高了土地的利用效率。所以,土地流转是社会发展到一定阶段的客观趋势。然而,在我国不断加快的工业化、城市化的背景下,农村因土地流转而导致的利益冲突现象日益增多,给我国社会可持续发展以及现代农业建设造成隐患。因此,研究并化解农村土地流转的利益冲突十分必要。本文采取文献研究与访谈相结合的方式,分为五部分来探讨土地流转利益冲突问题。绪论部分重点讨论该选题的背景及意义,以及国内外对该问题现有的研究综述,陈述相关概念界定以及研究思路、方法。第一章主要从改革开放前后两个阶段来解读土地流转制度发展过程中曾经出现的利益冲突问题。第二章总结了土地流转四大利益主体之间的冲突,如农民与农民、农民与村集体等不同主体之间的利益冲突,并进行归纳分析,第三章以我国当前土地流转的基本理论制度为基础,通过查阅资料以及访谈,拟对土地流转利益冲突的成因进行分析。第四章,从产权制度、流转机制、收益分配制度、监督机制以及社会保障机制等方面,结合土地制度相对来说较为成熟的日本、美国等国的经验,探究有利于我国农村土地制度改革的若干启示并提出一些探索性的建议。
[Abstract]:The reasonable circulation of land has greatly improved the efficiency of land use. Therefore, land circulation is the objective trend of social development to a certain stage. However, under the background of accelerating industrialization and urbanization in our country, the conflict of interest caused by land circulation in rural areas is increasing day by day, which brings hidden dangers to the sustainable development of our society and the construction of modern agriculture. Therefore, it is necessary to study and resolve the conflict of interest in rural land circulation. This paper adopts the combination of literature research and interview, which is divided into five parts to discuss the conflict of interest in land circulation. The introduction part focuses on the background and significance of the topic, as well as the existing research review of the issue at home and abroad, and states the definition of related concepts, research ideas and methods. The first chapter mainly interprets the conflict of interest in the development of land circulation system from the two stages before and after the reform and opening up. The second chapter summarizes the conflicts between the four major interest subjects of land circulation, such as the conflicts of interest between farmers and farmers, farmers and village collectives, and makes an induction and analysis. The third chapter is based on the basic theoretical system of land circulation in our country, through consulting data and interviews, the author intends to analyze the causes of the conflict of interest in land circulation. In the fourth chapter, from the aspects of property right system, circulation mechanism, income distribution system, supervision mechanism and social security mechanism, combined with the experience of Japan, the United States and other countries, which are relatively mature in the land system, this paper probes into some enlightenments and puts forward some exploratory suggestions which are beneficial to the reform of rural land system in our country.
