完善我国农村社会保障立法研究

【摘要】：社会保障制度的建立与完善是一个国家经济发展水平的重要标志。伴随着社会经济的发展，我国的社会保障制度已经基本建立，并走上了发展与完善的道路。但我国与西方经济发达国家的国情不同，农民占我国人口的绝大多数，是社会经济发展的重要支撑力量。因此，对于我国农民的社会保障研究应当成为我国社会保障工作的重点，加快我国农村社会保障立法的步伐，建立、健全我国农村社会保障法律制度，以法律形式有效地保障我国农民的社会基本生活。我国农村社会保障法律制度的构建，应当在保障农民的基本生活需求的基础上，以农村社会最低生活保障法律制度、农村社会养老保险法律制度、农村社会救助法律制度、农村社会医疗保险法律制度为基本框架，对我国农村的社会保障法律制度进行构建。因此，本文在研究我国农村社会保障法的基本现状的基础上，探讨我国农村社会保障法律制度的立法原则，，分析如何构建我国农村社会保障法律制度立法的内容，并提出了对我国农村社会保障法制建设的基本构想，期冀能够对完善我国农村社会保障立法有些许的意义。本文围绕如何构建我国农村社会保障法律制度的基本要求，运用综合分析的方法从法理、立法等角度，对我国农村社会保障法律制度进行了相对系统的研究，根据我国现阶段经济发展的基本状况和当前我国农村发展的实际情况，提出了一些自己的建议。本文共分三个部分：第一部分，主要阐述我国农村社会保障制度的涵义及其基本内容；第二部分，根据我国农村社会保障制度的基本内容，全面分析了我国农村社会保障制度的现状，找出其存在的具体问题；第三部分，在分析我国农村社会保障制度现状的基础上，阐述了本人对完善我国农村社会保障制度的基本构想，提出了解决现阶段在完善我国农村社会保障制度过程中所出现相关问题的基本举措。
[Abstract]:The establishment and perfection of social security system is an important symbol of a country's economic development level. With the development of social economy, the social security system of our country has been basically established and embarked on the road of development and perfection. However, different from the western developed countries, farmers account for the vast majority of the population of our country, which is an important supporting force for social and economic development. Therefore, the study of social security of farmers in our country should become the focus of social security work in our country, speed up the pace of legislation of rural social security in our country, establish and perfect the legal system of rural social security in our country, and effectively guarantee the basic social life of farmers in our country in the form of law. On the basis of ensuring the basic living needs of farmers, the legal system of rural social security in China should be constructed with the legal system of minimum living security in rural society, the legal system of rural social endowment insurance, the legal system of rural social assistance and the legal system of rural social medical insurance as the basic framework. Therefore, on the basis of studying the basic situation of rural social security law in China, this paper probes into the legislative principles of rural social security legal system in China, analyzes how to construct the legislative content of rural social security legal system in China, and puts forward some basic ideas for the construction of rural social security legal system in China, hoping that it will be of some significance to the perfection of rural social security legislation in China. Focusing on the basic requirements of how to construct the legal system of rural social security in China, this paper makes a relatively systematic study on the legal system of rural social security in China from the perspective of legal principle and legislation by using the method of comprehensive analysis, and puts forward some suggestions according to the basic situation of economic development in our country at the present stage and the actual situation of rural development in our country at present. This paper is divided into three parts: the first part mainly expounds the meaning and basic content of the rural social security system in our country, the second part, according to the basic content of the rural social security system in our country, comprehensively analyzes the present situation of the rural social security system in our country, and finds out the concrete problems existing in it. The third part, on the basis of analyzing the present situation of the rural social security system in our country, expounds my basic conception of perfecting the rural social security system in our country, and puts forward some basic measures to solve the related problems in the process of perfecting the rural social security system in our country at the present stage.
