反恐背景下金融隐私信息的跨境流动与保护——以SWIFT项目国际争议及其解决为视角

【摘要】："9·11"恐怖袭击之后,为获取恐怖活动线索,美国启动SWIFT项目获取欧盟公民的金融隐私信息,引发欧盟强烈抗议。欧美SWIFT项目争议产生的根源在于欧美金融隐私信息保护水平的差异。欧盟认为,美国政府从SWIFT组织获取涉恐金融隐私信息的过程中未能对欧盟公民金融隐私信息进行充分保护。为解决争议,欧美先后达成数个SWIFT协议,以在保护欧盟公民金融隐私信息和满足美国反恐需求之间寻求适度平衡。
[Abstract]:In the wake of the September 11 terrorist attacks, the United States launched Swift to obtain financial privacy information from EU citizens, provoking strong protests from the EU. The origin of the dispute of Swift project in Europe and America lies in the differences in the level of financial privacy information protection in Europe and the United States. The EU believes that the U.S. government has failed to adequately protect EU citizens' financial privacy information during the process of obtaining financial privacy information from Swift. To resolve the dispute, Europe and the United States have reached several Swift agreements to seek a proper balance between protecting EU citizens' financial privacy information and meeting U.S. counter-terrorism needs.
