构建“一带一路”贸易纠纷在线仲裁解决机制研究

【摘要】：随着"一带一路"贸易纠纷数量的不断上升,处理该区域纠纷的不同解决方式已成为法学界关注的焦点。现阶段,无论选择传统诉讼还是仲裁解决"一带一路"贸易纠纷问题都会因"一带一路"的复杂状况而面临诸多的法律和现实问题。因此,提出在互联网经济背景下,构建"一带一路"贸易纠纷在线仲裁解决机制以专门应对"一带一路"贸易中出现的各种纠纷问题,能够有利地规避使用传统法律在解决纠纷时所要面对的不同国家法律以及不同国家由于政治制度、经济实力和法律文化的巨大差异而对案件本身的影响。同时,使用"虚拟空间"进行仲裁也满足了互联网经济对高效、快捷的内在需求。"一带一路"贸易纠纷在线仲裁解决机制的构建,也是多元化纠纷解决机制的重要表现形式。
[Abstract]:With the increasing number of trade disputes of "Belt and Road", different solutions to disputes in the region have become the focus of attention in the field of law. Whether we choose traditional litigation or arbitration to resolve the trade disputes of Belt and Road, we will face many legal and practical problems because of the complex situation of "Belt and Road". Therefore, it is proposed that in the context of Internet economy, To set up an online arbitration settlement mechanism for trade disputes of "Belt and Road" to deal with all kinds of disputes arising in the trade of "Belt and Road". To be able to circumvent favourably the different national laws that the use of traditional law faces in resolving disputes and the impact of the enormous differences in political system, economic power and legal culture in different countries on the case itself... at the same time, The use of "virtual space" for arbitration also meets the internal needs of the Internet economy for efficiency and speed. The construction of online arbitration settlement mechanism for trade disputes of "Belt and Road" is also an important manifestation of the diversified dispute resolution mechanism.
