吉尔吉斯斯坦矿产业投资法律环境评析

【摘要】：在我国“一带一路”战略的推动下,中亚国家与中国建立了紧密合作的关系,为中吉两国进步经贸合作提供了良好基础,吉国为加速市场经济的改革,迫切需求外资投入,吉国矿产能源储量丰富,品质优良,加之其宽松的投资环境、对外资企业制定的优惠政策,与我国的临近地缘优势都对我国企业在吉投资具有一定吸引力。因此,研究吉尔吉斯斯坦矿产业投资法律环境对于我国企业在吉国投资具有重要意义。本文总共分为六个部分:第一部分:引言。本部分介绍了论文研究背景和意义、国内外研究综述、文章采用的研究方法以及论文的创新之处和不足,并对文章框架予以说明。第二部分:吉尔吉斯斯坦矿产业投资环境概述。第二部分先对吉国《地下资源法》进行了初步的介绍,其后,对吉国目前投资立法,及其指导思想进行介绍。最后,结合目前我国“一带一路”的重要战略指导,介绍了目前中吉两国的矿业投资合作环境。第三部分:吉国矿产业投资法律制度。这一部分先介绍了吉国矿产业法律制度的体系,其次,依照体系分别介绍了《地下资源法》、《投资法》及新《税法》的相关法律规定内容。最后,分析了吉国自由经济区的法律规定,让读者明晰吉国对矿产业投资的具体法律规定。第四部分和第五部分:分别介绍了促进中吉矿业合作开发的有利条件和其限制因素。首先通过之前文章对相关法律规定的内容以及“一带一路”战略实施的意义,总结出促进投资合作的有利条件;之后在对吉国目前社会实际法律执行及守法现状进行多角度分析,提出限制中吉两国投资合作的因素。第六部分中国矿产业投资者在吉国投资的建议。此部分是整篇文章的重点。通过总结本文主要观点,结合中吉两国矿产业投资合作的现状以及存在的主要法律问题对中国在吉国投资矿产业的投资者提出了三个方面的相应对策建议。
[Abstract]:Under the impetus of China's "Belt and Road" strategy, Central Asian countries have established close cooperation with China, which provides a good basis for China and Kyrgyzstan to advance economic and trade cooperation. Kyrgyzstan urgently needs foreign investment to speed up the reform of the market economy. Kyrgyzstan is rich in mineral energy reserves, excellent in quality, and its loose investment environment, the preferential policies for foreign-funded enterprises, and our country's geographical advantages are attractive for our enterprises to invest in Kyrgyzstan. Therefore, it is of great significance for Chinese enterprises to study the legal environment of mining investment in Kyrgyzstan. This article is divided into six parts altogether: the first part: introduction. This part introduces the research background and significance of the paper, the domestic and foreign research review, the research methods adopted, the innovation and shortcomings of the paper, and explains the framework of the paper. Part two: an overview of the investment environment of Kyrgyzstan's mineral industry. The second part first introduces the law of underground resources, and then introduces the present investment legislation and its guiding ideology. Finally, combined with the important strategic guidance of Belt and Road, the present environment of mining investment cooperation between China and Kyrgyzstan is introduced. The third part: Kyrgyzstan country mineral industry investment legal system. This part first introduces the legal system of the mining industry in Kyrgyzstan, and then introduces the contents of the relevant laws and regulations of the underground resources law, the investment law and the new tax law according to the system. Finally, the article analyzes the laws and regulations of Jilin Free Economic Zone, and makes the readers clear the specific legal provisions of Kyrgyzstan's investment in mining industry. The fourth part and the fifth part: it introduces the favorable conditions and the restrictive factors of promoting the development of Sino-Kyrgyz mining industry. First of all, through the content of the relevant laws and regulations and the significance of "Belt and Road" strategy implementation before the article, summed up the favorable conditions to promote investment cooperation; After that, the author analyzes the actual law enforcement and law-abiding situation in Kyrgyzstan from various angles, and puts forward the factors restricting the investment cooperation between China and Kyrgyzstan. The sixth part is the suggestion of Chinese mineral industry investors investing in Kyrgyzstan. This section is the focus of the whole article. Through summing up the main points of view of this paper, combined with the present situation of China and Kyrgyzstan mineral industry investment cooperation and the main legal problems, this paper puts forward three corresponding countermeasures and suggestions for Chinese investors who invest in mining industry in Kyrgyzstan.
