宋代告赏立法探析

【摘要】：宋朝告赏法涉及的范围极其广泛,刑事犯罪、政治、经济、军事、社会生活、思想文化等领域均广立告赏法。宋朝告赏法的推行积极而有效,有利于政府打击各类违法犯罪行为,稳定社会秩序,保障民众的生命财产安全;并在一定程度上减少国有资产的流失,增加财政收入。同时告赏法的推行也带来负面影响,由于告赏法过多过滥,以致民间形成告讦之风,奸猾之人无所不告以至于家家有告讦之忧,人人有隐落之罪,影响到百姓的生计与生产的发展,导致社会风气的败坏。
[Abstract]:The law of suing and reward in the Song Dynasty covers a wide range of fields, such as criminal, political, economic, military, social life and ideological and cultural fields. The positive and effective implementation of the law is beneficial to the government in cracking down on all kinds of illegal and criminal acts, stabilizing the social order, ensuring the safety of people's lives and property, and reducing the loss of state-owned assets to a certain extent and increasing the financial revenue. At the same time, the implementation of the law of prosecution and reward also brought negative effects. As a result of the excessive abuse of the law of suing and reward, the folk formed a style of criticism, and the cunning people did everything to the point that every family was worried about being accused of criticism, and that everyone had the crime of secret punishment. Affect the livelihood of the people and the development of production, leading to the deterioration of social atmosphere.
