绍兴冤狱与南宋初年的政治变奏
[Abstract]:In Shaoxing, the mass miscarriage of justice was not a conventional means for political groups to fight for power, but a political act moving between law and politics. The thought of presumption of guilt, which runs through the process of trial and sentence in Shaoxing, does not break the accusation and evidence from the legal rules. Even the severe punishment at the end of the case is based on the immediate legal theory. The political point of view behind the legal analysis of Shaoxing's unjust prison can be attributed to the immediate implementation of Shaoxing's national policy, thus revealing directly the political motive of the Song Gaozong regime in the early years of the Southern Song Dynasty, which did not hesitate to touch the moral balance and create unjust prison.
