明代西域来华使臣的违法与违禁

【摘要】：明代西域来华使臣中有少数使臣违犯或故意违犯明朝的法律或禁令。明廷对西域来华使臣的违法违禁行为,处置较宽,但对与违法使臣相关的明朝军民处罚非常严厉。明朝前期,厚赐使臣,一些使臣的违法行为多是使臣对明朝法律规定无知所为。成化以后,国家财力有限,明朝给予使臣的赏赐减低,追求利益的贸易使臣或嫌赏赐太薄,或冒滥王号,或违禁贸易,以求厚利。各种违禁现象较多。为此,明朝制定了针对使臣的各种禁约措施加以管理。相对其他地区来华使臣而言,西域来华使臣违法违禁行为较多,这与西域在明朝外交方略中的作用和地位有关,也与明朝朝贡制度有关。
[Abstract]:In the Ming Dynasty, a few of the envoys in the Western regions violated or deliberately violated the laws or prohibitions of the Ming Dynasty. The Ming court dealt with the illegal and prohibited behavior of the envoys in the Western region, but it severely punished the Ming military and the people who were related to the illegal envoys. In the early Ming Dynasty, some emissaries acted illegally because they were ignorant of the legal provisions of the Ming Dynasty. After formalization, the national financial resources were limited, the reward of the Ming Dynasty to the emissaries was reduced, the trade envoys who pursued the interests were either too thin to reward, or they took the names of excessive kings, or violated the prohibition of trade, in order to make a good profit. Various kinds of illegal phenomena are more. To this end, the Ming Dynasty formulated a variety of proscription measures for envoys to be managed. Compared with other countries, the Western region has more illegal and illegal acts, which is related to the role and status of the Western region in the diplomatic strategy of the Ming Dynasty and the tributary system of the Ming Dynasty.
