三国时期孙吴法律体系研究

【摘要】：三国时期的孙吴由于偏安一隅，在历史上似乎总是处于一个很尴尬的位置，无论是正史还是演义小说，其中心总是主要围绕曹魏与蜀汉展开，而孙吴往往属于藏身于二者之后的陪衬，而这也是孙吴法制在三国法制中地位的真实写照。由于孙吴的法律多承于汉制，少有建树，且年代久远，其法律原文早己遗失，其他史料中关于孙吴法制的状况也着墨不多，故而孙吴法制往往被后人所忽略，一直处于曹魏与蜀汉法制的阴影之下。笔者撰写此文的目的，就是希望以《三国志》中的史料为主，辅之以历代典籍文献中关于孙吴法制的记载，搭建出一个完整的孙吴法律体系，揭丌这个一直被曹魏、蜀汉法制的光芒所掩盖的，“三国法制中永远的配角”的庐山真面目。本文从孙吴的立法状况入手，通过史料分析当时孙吴统治集团的主要法律思想，，以此为基础对孙吴仅有的几次立法活动进行重点研究，分析其立法的背景以及立法活动的主要内容。进而将孙吴法律体系拆分为四个主要部分：刑事法律制度、民事法律制度、诉讼审判制度、司法机构设置，分别进行研究。在刑事法律制度部分，主要通过列举《三国志》中的典型案例，推断孙吴时期存在的罪名以及刑罚执行方式，并对孙吴时期的大赦进行专门研究；在民事法律制度部分，主要是结合各种史料，特别是长沙走马楼吴简，对孙吴的土地制度、赋税制度、货币制度、婚姻家庭制度、户籍制度进行分析，研究这些制度的基本情况以及历史背景；在诉讼审判制度部分，主要研究孙吴的证据制度与审讯方式，并分析实施这些制度的主要原因；在司法机构设置方面，主要考证孙吴的中央与地方的司法机构设置情况，并重点研究校事这种特殊的司法机构。在对孙吴法律体系梳理完毕后，综合前文的论述，进一步分析出孙吴法律体系的主要特点，并由此对孙吴法制的成败得失进行评述，从而得出最后的结论。
[Abstract]:Sun Wu in the period of three Kingdoms always seemed to be in a very awkward position in history because of his bias. Whether it was official history or romance novels, his heart was always centered around Cao Wei and Shu Han. Sun Wu often belongs to the background of hiding behind the two, and this is also the true portrayal of the status of the legal system of the three Kingdoms. Because the laws of Soong Wu are mostly inherited from the Han system, few achievements have been made, and they have been for a long time. The original text of his law has long been lost, and other historical materials about the legal system of Soon-Wu are not much, so the legal system of Soon-Wu is often ignored by later generations. Under the shadow of the legal system of Cao Wei and Shu Han, the purpose of writing this article is to hope that the historical materials in "the Records of the three Kingdoms" will be given priority to, supplemented by the records of the legal system of the Sun Wu in the literature of the ancient dynasties. Set up a complete legal system of Sun Wu, and uncover the truth of the "eternal supporting role in the legal system of the three Kingdoms", which has been concealed by the light of the law of Cao Wei and Shu Han. Starting from the legislative situation of Soong Wu, this paper analyzes the main legal thoughts of Soong Wu ruling group through historical data, and based on this, focuses on the few legislative activities of Soong Wu. It analyzes the background of its legislation and the main content of legislative activities. Then it divides the legal system of Soon-Wu into four main parts: criminal legal system, civil legal system, litigation and trial system, and judicial institution setting. Respectively. In the part of criminal law system, mainly through enumerating the typical cases of "the three Kingdoms", we infer the existing charges and the way of penalty execution in the Soon-Wu period. And carry on the special research to the amnesty of the Soon-Wu period; In the part of civil legal system, it mainly combines with various historical materials, especially the Wu slips of Ma Lou in Changsha, analyzes the land system, tax system, currency system, marriage and family system, and household registration system of Sun Wu. To study the basic situation and historical background of these systems; In the part of litigation trial system, the paper mainly studies the evidence system and trial methods of Soong Wu, and analyzes the main reasons for the implementation of these systems. In the establishment of judicial institutions, mainly textual research on the establishment of the central and local judicial institutions of Soong Wu, and focus on the school affairs of this special judicial institutions. After sorting out the legal system of Soong Wu. In this paper, the main characteristics of the legal system of Soong Wu are further analyzed, and the success or failure of the legal system of Wu is reviewed, and the final conclusion is drawn.
