明代官员给假制度研究

【摘要】:所谓“给假制度研究”,主要是从政府与入仕者的双重角度观察、分析明代官员围绕省亲、丁忧、告病三类非常规事宜所进行的请假活动。区别于过往单纯以制度文本为切入点的同类研究,本文更多地将研究重点转向“制度制作理念”与“制度现实运行”,以期通过对“制作理念→制度文本→现实运行→制度文本”的动态考察,窥得明代官员给假制度全貌以及官员政治生活之一角。 第一章“明代官员省亲给假制度”,主要论述了官员省亲给假制度的历史嬗变及在明代的具体表现;明代官员省亲给假制度的制作理念,即缘何理由允许官员省亲行为的发生;省亲给假制度在明代的现实运作,大致衍生出四类情况,因私废公的诈取省亲、以公去私的禁止省亲、公私兼顾的便道省亲、因私害公的枉道省亲。 第二章“明代官员丁忧给假制度”,主要论述了官员丁忧给假制度的历史嬗变及在明代的具体表现,包括丁忧给假主体、适用对象、给假期限、给假程序、丁忧严禁行为及犯禁惩处等;探析了丁忧给假制度的制作理念,兼顾人情与政治需求;丁忧给假制度在明代的现实运作,大致衍生出三类情况,丁忧守制、匿丧以避丁忧与诈丧以求丁忧、政府夺情不许守制。 第三章“明代官员告病给假制度”,主要论述了官员告病给假制度的历史嬗变及在明朝的具体表现,较之以往,明代的告病给假制度内容呈现出分类绵细、手续繁琐、防范严密的特征;告病给假制度在明代的现实运作,,衍生出了托疾、托病以谋私的现象。 结论部分指明,通过梳理明代官员给假制度的相关规定,可以清晰看出,给假制度的不断调整是对其在现实运作中出现问题的直接反应,以此为契机,明代官员给假制度逐渐走向完善。然而,由于人之私情的存在,对制度的违反与变相利用从未消失。
[Abstract]:The so-called "study on the system of giving leave" is mainly from the perspective of both the government and those who have entered the office, and analyzes that the officials of the Ming Dynasty revolved around the province and worried about their relatives. Absence activities in three categories of unconventional matters, as distinguished from similar studies that used to be based solely on institutional texts. In this paper, the focus of the research will be shifted to the "system production concept" and "system reality operation", with a view to the "production concept" 鈫扞nstitutional text. 鈫扲eal operation. 鈫扵he dynamic investigation of the text of the system reveals the whole picture of the system of official impersonation in the Ming Dynasty and a corner of the official's political life. In the first chapter, the author discusses the historical evolution of the system and its concrete performance in the Ming Dynasty, the production concept of the system, that is, the reason for allowing the occurrence of the behavior of the officials in the province of parental leave; the first chapter, "the system of giving leave to officials in the Ming Dynasty", mainly discusses the historical evolution of the system of giving leave to the relatives of officials and its concrete performance in the Ming Dynasty. In the Ming Dynasty, there were four kinds of situations in the practice of the province-to-leave system, such as the private abolition of the public, the prohibition of the public going to the private sector, the public and the private side of the road, and the private harm to the public. The second chapter, "the system of giving leave to officials in Ming Dynasty", mainly discusses the historical evolution of the system of giving leave to officials and its specific performance in the Ming Dynasty, including the subject of giving leave, the object of application, the period of giving leave, the procedure of giving leave. The author probes into the production concept of the system of giving leave to Ding worry, which takes account of human feelings and political needs. The actual operation of the system of giving leave of care of Ding worry in the Ming Dynasty has roughly derived from three kinds of situations, namely, the system of worrisome giving and giving leave. Hiding mourning to avoid worry and deceit to ask for worry, the government will not abide by the situation. The third chapter, "the system of officials' sick leave in the Ming Dynasty", mainly discusses the historical evolution of the system and its specific performance in the Ming Dynasty. Compared with the past, the contents of the system of reporting and giving sick leave in the Ming Dynasty are classified in detail, and the procedures are cumbersome. Strict features of prevention; the actual operation of the system in Ming Dynasty, derived from the disease, disease for private phenomenon. The conclusion points out that by combing the relevant provisions of the system of giving leave to officials in the Ming Dynasty, it is clear that the continuous adjustment of the system of giving leave is a direct response to the problems in its practical operation, taking this opportunity as an opportunity. However, due to the existence of personal feelings, the violation and disguised use of the system never disappeared.
