春秋诸侯国内执罪的制度依据与基本类型

【摘要】：从春秋时期以"执"的方式对涉嫌违礼坏法者加以追责问罪的现象观察,当时各诸侯国国内执罪的制度依据是宗法封建的礼制传统,在承认"国"的国内最高权威的前提下,贯彻了"国"与"家"分层并行而治的原则。由此,各诸侯国国内执罪可以分为"为国者执罪"和"治家者执罪"两种基本类型。
[Abstract]:During the Spring and Autumn period, we observed the phenomenon that those suspected of violating the rules of etiquette and bad laws were pursued and questioned by the way of "holding" the law in the Spring and Autumn period. At that time, the system of crime enforcement in various countries was based on the tradition of patriarchal and feudal etiquette, and on the premise of recognizing the supreme authority of the "state" at home, Carried out the principle of "country" and "home" parallel and governance. As a result, there are two basic types of crime in each monarch country: the one who holds the crime for the country and the one who holds the crime for the family.
