中国古代“律族”法律文书名词研究

【摘要】：“律族”法律文书名词是中国古代法律文书名词中的一个重要组成部分,最早出现于春秋时期,并且随着历史的推进,其使用频率越来越高,使用范围越来越广,内涵也越来越丰富。关于“律族”法律文书名词,既在中国古代文档名词、中国古代文书史、中国古代档案史研究的范畴内具有重要的学术意义,也在中国古代语言文字范畴内具有重要的学术意义。本文主要运用历史计量语言学和统计分析的方法来对其族类法律文书名词,包括“律法”“律令”“法律”“律科”“禁律”“律例”“律条”法律文书名词来进行一个简要的分析。并根据其出现的时间、使用情况和内涵演变等的分析情况来总结出“律族”法律文书名词在整个中国古代历史发展中所具有的特点和演变规律,从而说明其在所有的文档名词族类中所占据的重要地位。“律”从早期的地名、道路的含义。发展成为历法、度量衡、音律的义项,最后发展成为稳定的规则、规范的义项,又以这一义项为基础形成了法律文书含义的义项。其在形成的过程中,与其他的具有相同含义的词,形成了一系列的含有法律义项的文书名词,而其最早出现也不是作为法律文书名词来使用的,发展到法律文书名词也经历了一段时间,而后,这些法律文书名词组成了“律族”法律文书名词。这些法律文书名词出现于先秦时期,成长于三国两晋南北朝时期,最后稳定于唐宋时期,是中国古代法律文书名词中不可缺少的一部分。本文第一部分写了律的起源和“律族”法律文书名词的形成。第二部分写了其在古代的应用。第三部分和第四部分分别对各个文书名词进行了分析,对它们的使用次数和频次、相关文献的内容进行分析,来具体研究它们的使用情况,从而总结出一定的规律。对于专门语言学下的历史学、档案学、文书学和法学的研究,都有重要的意义。
[Abstract]:The legal document nouns of "law clan" are an important part of the ancient Chinese legal documents. They first appeared in the Spring and Autumn period, and with the development of history, their use frequency is higher and higher, and the scope of their use is more and more extensive. The connotation is also more and more abundant. The legal document noun of "law family" has important academic significance in the category of ancient Chinese document noun, ancient Chinese document history and Chinese ancient archival history. Also has the important academic significance in the Chinese ancient language writing category. This paper mainly uses the methods of historical econometrics and statistical analysis to analyze the legal documents of their families. A brief analysis of the terms "law", "prohibition", "law", "law" and "law" Based on the analysis of the time of its appearance, the situation of its use and the evolution of its connotation, this paper summarizes the characteristics and evolution of the legal documents of the "law clan" in the development of the whole ancient history of China. This explains its important position in all kinds of document nouns. "Law" from the early place names, the meaning of the road. It developed into a meaning of calendar, measurement, and rhythm, and finally developed into a stable rule, a standard meaning, and based on this meaning formed the meaning of legal document. In the process of its formation, with other words with the same meaning, it formed a series of instrument nouns with legal meaning, and its earliest appearance was not used as a legal document noun. It developed into legal clerical nouns for a period of time, and then these legal clerical nouns formed the legal family of legal clerical nouns. These legal documents appeared in the pre-Qin period, grew up in the three Kingdoms, Jin, Southern and Northern dynasties, and finally stabilized in the Tang and Song dynasties, which is an indispensable part of the ancient Chinese legal documents. The first part of this paper describes the origin of the law and the formation of legal documents. The second part describes its application in ancient times. In the third part and the fourth part, the author analyzes the noun of each instrument, analyzes their frequency and frequency, and the contents of the relevant literature to study their usage, and sums up some rules. It is of great significance for the study of history, archives, clerical science and law under specialized linguistics.
