1495年“帝国改革”与神圣罗马帝国和平秩序建构之制度困境的反思

【摘要】：为重构帝国的权力秩序,神圣罗马帝国皇帝马克西米利安一世不得不与帝国阶层妥协,通过在全帝国范围内执行《永久和平条例》、征收"公共芬尼"税、设立帝国最高法院等改革措施来维持帝国内部的和平与秩序。但是,由于神圣罗马帝国本身自始即存在的诸多制度性缺陷,1495年的帝国改革并未取得较多的预想成果。尽管如此,1495年沃尔姆斯帝国议会所确立的"帝国改革"初步建构起维护帝国和平与秩序的制度化机制,皇帝与邦国诸侯逐渐在改革所确立的制度框架内以和平的方式解决纷争,为其后帝国和平与秩序的发展奠定了基础。
[Abstract]:For the reconstruction of imperial power order, holy Rome Empire emperor Milian I had to maxi and Empire class compromise, in the whole empire through the wide implementation of the "permanent peace Ordinance", "public collection of Finney", the Supreme Court established the imperial tax reform measures to maintain peace and order of the empire. However, because of the many institutional defects that existed from the beginning of the Holy Rome Empire itself, the reform of the Empire in 1495 did not achieve much preconceived results. Nevertheless, established in Worms in 1495 the imperial parliament "imperial reform" set up the maintenance mechanism of peace and order in the Empire, the emperor and the state governors gradually established the framework of the system reform in a peaceful way to solve disputes, which laid the foundation for the later development of the Empire and the peace and order.
