【摘要】：迈克·桑德尔的社群主义公正观是当代西方政治哲学研究的热点话题,其对于罗尔斯的批判引起了国内外学者的热切关注。在探讨“何为公正”、“怎样做更加公正”这两个问题时,他主张善优先于权利,因此应当从共同体的“善”的角度界定公正的标准,桑德尔认为公正原则应该有其自身的道德力量,公正的正当性证明应当依赖它所满足目的的道德价值或内在“善”,这种“善”从根本上说,是自治的共同体民主商谈的结果。本文在详细论述桑德尔公正思想的基础上,进行了历史唯物主义视角的批判性考察,全文论证逻辑如下:全文第一部分在对桑德尔公正思想国内外综述基础上确定本论文选题创新之处以及简要探讨公正在历史唯物主义体系中的地位;第二部分详细的从理论渊源(梳理康德、边沁、密尔、诺齐克以及罗尔斯的公正思想的历史性演变)与内容方面(权利与善的关系、公正的现实表现、实现路径、社会作用)探讨桑德尔公正思想;第三部分着重从历史唯物主义视角对桑德尔公正思想的基础——共同体的“善”、桑德尔公正思想的实现路径——民主与公正的证成方式、“保守主义”色彩进行批判性考察;第四部分在前文的基础上探讨桑德尔公正思想理论层面(对马克思主义政治哲学发展)与现实层面(对促进当代中国和谐及如何实践当今公正价值等)若干启示。
[Abstract]:Michael Sandel's view of communitarianism and justice is a hot topic in the study of contemporary western political philosophy. His criticism of Rawls has aroused the keen attention of scholars both at home and abroad. In discussing the two issues of "what is justice" and "how to do more justice", he advocates that good take precedence over rights. Therefore, the criterion of justice should be defined from the point of view of the "good" of the community, and Sandel believed that the principle of justice should have its own moral power. The justification of justice should depend on the moral value or inner "good" of the purpose it satisfies, which is fundamentally the result of democratic negotiation in autonomous community. The critical investigation from the perspective of historical materialism, The logic of the full text is as follows: in the first part of the thesis, on the basis of summing up Sandel's theory of justice at home and abroad, the author determines the innovation of this thesis and briefly discusses the position of justice in the historical materialism system; The second part from the theoretical origin (combing Kant, Bentham, Mill, Nozick and Rawls of the historical evolution of the idea of justice) and content (the relationship between rights and good, the realistic expression of justice, the path to realization, Social role) to probe into Sandell's thought of justice; The third part focuses on the historical materialism from the perspective of Sandel's thought of justice-the foundation of the Community "good", the realization of Sandel's thought of justice-the way of democracy and justice, "conservatism" color to carry on the critical investigation; The fourth part discusses the enlightenment of Sandel's theory of justice (to the development of Marxist political philosophy) and reality (to promote the harmony of contemporary China and how to practice the value of justice) on the basis of the above.
