论政治责任与刑事责任的权力基础

【摘要】：现代国家政治是责任政治,责任政治的实现或者说法治国家的建设需要辅以基本的法治理念、正当程序保障以及由此而实现的社会公平正义。就法治国家的建设而言,离不开合理与公正的解决政治责任与刑事责任。政治责任与刑事责任在渊源上具有共通性,即国家权力及其运行。而且,在国家权力的指引下,各自承担着积极的功用,但也会产生消极的作用。基于此,需要对权力进行监督、规制,引导权力为民所用,从而促进社会公平正义的实现。
[Abstract]:Modern politics is the responsibility of the political construction, political responsibility to achieve the rule of law or the needs of the country with the basic concept of the rule of law, due process protection and social justice. Which is the construction of the rule of law, cannot do without a reasonable and fair treatment to solve the administrative responsibility and criminal responsibility and criminal responsibility has political responsibility. Common in origin, namely the state power and its operation. Moreover, the power in the country under the guidance of their commitment to a positive function, but also have a negative role. Based on this, the need for supervision and regulation of power, power to guide for the people, so as to promote the realization of social fairness and justice.
