马克思主义人权理论中国化历史进程及实践研究

【摘要】：人权问题是当今世界普遍关注的热点问题之一。享有充分的人权,一直是人类追求的理想。对于人权问题,不同的国家有着不同的看法,有些甚至是尖锐对立的。近年来,国际人权斗争日趋激烈,一些西方国家极力推行所谓的“人权外交”,鼓吹“人权高于主权”、“人权无国界”、“人道主义干涉论”等论调,试图借人权问题来干涉他国内政。在这种情况下,认真的学习和研究马克思主义人权理论有着十分重要的现实意义。我国是社会主义国家,在人权问题上坚持马克思主义的人权观,并积极的在革命和建设中将马克思主义人权理论与我国的国情及具体实践结合起来,解决中国的具体的问题。本文围绕“马克思主义人权思想中国化”这个主题,用理论联系实际的科学方法,阐述了马克思主义人权观的科学内涵;依据党的文献和中国共产党人关于人权的论述,对马克思主义人权理论的中国化历史进程进行了系统的研究;论述了马克思主义人权理论在中国的具体实践;在此基础上,总结出马克思主义人权理论在中国实践运用的经验启示。论文由六章组成,其中包括一个引言、四章正文和一个结论。第一章引言主要介绍了研究背景,论题的理论价值和现实意义以及国内外学术界关于该论题的研究状况。第二章通过对马克思恩格斯人权思想形成的历史过程、马克思恩格斯人权思想的基本观点和特征、列宁对马克思主义人权理论的重要贡献及斯大林对苏联人权制度的建设和贡献的分析,在总体上把握对马克思主义人权思想,力求对马克思主义人权理论的研究做到全面、系统。第三章以党的领导人的人权思想为中心线索,论述马克思主义人权思想在中国的发展,研究了毛泽东、邓小平、江泽民和胡锦涛人权思想,对马克思主义人权理论的中国化的历史进程运用进行系统的研究。第四章理论联系实际,重点研究了弱势群体人权的保障,对马克思主义人权理论在中国具体实践运用取得的重大成果进行分析。第五章通过本文前几章的研究,总结马克思主义人权理论在中国实践运用的经验启示,主要包括:(1)坚持马克思主义人权观的主导地位(2)坚持党的领导,走中国特色社会主义道路,是中国人权发展的前提条件;(3)改革开放,是中国人权发展的必有之路;(4)解放思想,与时俱进,是中国人权事业发展的动力;(5)民主法治,是中国人权事业发展的内在需求;(6)社会稳定,走和平发展道路,是中国人权继续发展的必然要求;(7)以人为本,体现了马克思主义人权理论的本质内涵。第六章结论得出马克思主义人权理论中国化是依据我国国情在实践中不断发展的,是一脉相承,与时俱进的。
[Abstract]:Human rights is one of the hot issues in the world.The enjoyment of full human rights has always been the ideal pursued by mankind.On human rights issues, different countries have different views, some even sharp opposition.In recent years, the international human rights struggle has become increasingly fierce. Some Western countries have vigorously pursued so-called "human rights diplomacy," preaching such arguments as "human rights above sovereignty," "human rights without borders," "humanitarian intervention theory," and so on.Try to interfere in the internal affairs of other countries on the basis of human rights issues.In this case, the study and study of Marxist human rights theory has a very important practical significance.As a socialist country, China adheres to the Marxist concept of human rights on the issue of human rights, and actively combines Marxist theory of human rights with China's national conditions and practice in the course of revolution and construction to solve China's specific problems.Based on the theme of "Sinicization of Marxist human rights thought", this paper expounds the scientific connotation of Marxist human rights concept by means of the scientific method of integrating theory with practice, according to the literature of the Party and the exposition of human rights by the Chinese Communists.This paper makes a systematic study on the historical process of the Sinicization of Marxist human rights theory, discusses the concrete practice of Marxist human rights theory in China, and on this basis,This paper summarizes the experience and enlightenment of Marxist human rights theory in China.The thesis consists of six chapters, including an introduction, four chapters and a conclusion.The first chapter introduces the background of the research, the theoretical value and practical significance of the topic and the research situation of the academic circles at home and abroad.In the second chapter, through the historical process of the formation of Marx and Engels' human rights thought, the basic viewpoints and characteristics of Marx and Engels' human rights thought are introduced.Lenin's important contribution to the Marxist theory of human rights and Stalin's analysis of the construction and contribution of the Soviet Union's human rights system, as a whole, grasps the Marxist human rights thinking and strives to study the Marxist theory of human rights in an all-round way.System.The third chapter takes the human rights thought of the party leader as the central clue, discusses the development of the Marxist human rights thought in China, and studies the human rights thoughts of Mao Zedong, Deng Xiaoping, Jiang Zemin and Jiang Zemin.This paper makes a systematic study on the application of Marxist human rights theory in China.The fourth chapter focuses on the protection of the human rights of the vulnerable groups, and analyzes the major achievements in the practical application of Marxist human rights theory in China.The fifth chapter summarizes the experience and enlightenment of the practical application of Marxist human rights theory in China through the research of the previous chapters of this paper, mainly including: 1) insisting on the leading position of Marxist view of human rights and 2) adhering to the leadership of the Party.To follow the road of socialism with Chinese characteristics is a prerequisite for the development of human rights in China. It is a prerequisite for the development of human rights in China.
