行政异体问责制研究

【摘要】：责任政府是一种与国家的政治构架和法律运作紧密相关的制度设计,是政治文明的重要标志和重要保障。建立责任政府的关键,是要通过问责来落实政府的责任。目前,我国正在致力于建设责任政府,行政问责机制的构建和完善对于建立责任政府必不可少。随着我国行政管理体制改革的进一步推进,行政问责制也得到了快速的发展。行政问责以其问责主体的不同,应当分为同体问责和异体问责两种。但是,理论研究和实践检验结果表明,行政异体问责更加符合社会主义民主政治的要求,对政府及其工作人员的监督制约更为有效。然而遗憾的是,由于我国行政问责起步较晚,加之受传统观念的影响,我国行政异体问责基本上处于缺位状态,学术界对这一问题也关注较少,没有形成系统的研究论述。因此,对于行政异体问责制进行深入研究,具有一定的理论和实践意义。本文共分为五个部分：第一部分为导论。第二部分对行政异体问责的概念、基本理论、内涵及其特征以及行政异体问责的意义进行论述。第三部分主要分析研究目前我国行政异体问责的现状及其存在的问题。第四部分是分析并借鉴西方主要发达国家和我国香港地区行政异体问责制度。第五部分在分析问题、借鉴经验和结合我国实践的基础上,提出我国行政异体问责体制构建和程序设计方面的建议。
[Abstract]:Responsible government is a kind of system design which is closely related to the political framework and legal operation of the country. It is an important symbol and guarantee of political civilization. The key to establishing responsible government is to fulfill the responsibility of government through accountability. At present, our country is devoting itself to the construction of responsible government, and the construction and perfection of administrative accountability mechanism is essential to the establishment of responsible government. With the further development of China's administrative system reform, the administrative accountability system has also been developed rapidly. Administrative accountability should be divided into homogenous accountability and allogeneic accountability. However, the results of theoretical research and practical test show that the administrative allogeneic accountability is more in line with the requirements of socialist democratic politics, and the supervision and restriction to the government and its staff is more effective. However, unfortunately, due to the late start of administrative accountability in our country, coupled with the influence of traditional concepts, the administrative allogeneic accountability in our country is basically in a state of absence, and the academic community has paid little attention to this issue, and has not formed a systematic study on this issue. Therefore, it has certain theoretical and practical significance to study the administrative allogeneic accountability system in depth. This paper is divided into five parts: The first part is an introduction. The second part discusses the concept, basic theory, connotation and characteristics of administrative allogeneic accountability as well as the significance of administrative allogeneic accountability. The third part mainly analyzes the present situation and existing problems of administrative allogeneic accountability in China. The fourth part is to analyze and draw lessons from the main developed countries and China's Hong Kong administrative allogeneic accountability system. The fifth part is based on the analysis of the problems, the experience and the practice in our country, and puts forward some suggestions on the construction of the administrative allogeneic accountability system and the procedure design in our country.
