超越的困境:福柯的权利政治观

【摘要】：福柯晚期对权利的强调与其早期对权利的批判立场看似难以调和,实则一脉相承,代表着超越既有权利理论的宝贵努力。一方面,他认为传统的自由主义权利虽然可以有效制约国家权力,却无力对抗规训权力这一现代权力形式,反而沦为后者附庸。另一方面,正是传统权利的这一不足,福柯期待着一种足以对抗现代权力的新型权利。此种权利具有差异性、日常性与不确定性等特点,尽管在理论层面可以消解现代权力对个体的压迫,但在现实层面,则面临实施之后权利诉求激增、社会成本加重、秩序瓦解等一系列困境,最终,这一新型权利不仅无力对抗规训,甚至将个人自由置于更大的险境之中。
[Abstract]:Foucault's emphasis on rights in his later years seemed difficult to reconcile with his early critical stance on rights, but in fact, it continued in the same vein, representing a valuable effort to transcend the theory of existing rights. On the one hand, he thinks that although the traditional liberalism rights can effectively restrict the state power, they can not resist the modern power form of discipline power, but they become the latter appendages. On the other hand, it is this deficiency of traditional right that Foucault expects a new right which can resist modern power. This kind of right has the characteristics of difference, normality and uncertainty. Although it can eliminate the oppression of modern power on the individual in theory, but in reality, it faces a sharp increase in the demand for rights after its implementation, and the social cost is increased. A series of dilemmas, such as the breakdown of order, led not only to the new right's inability to confront discipline, but even to put individual freedom at greater risk.
