政治关系、制度环境与多元化商业纠纷解决机制

【摘要】：本文重点关注转型期民营企业在卷入商业纠纷时如何选择纠纷解决机制,以及企业家政治身份和制度环境的影响差异。利用全国民营企业抽样调查数据实证发现,企业选择的纠纷解决途径是多元化的,其中有政治关系的企业更愿意诉诸"法院仲裁"和"政府渠道"的国家解纷机制;在更"差"的环境中,有政治关系的企业更倾向于选择法律诉讼而非寻求政府渠道。此外,政治关系有助于提升纠纷解决的事后满意度,而且在"差"制度下,这种影响更大。
[Abstract]:This paper focuses on the choice of dispute resolution mechanism when private enterprises are involved in commercial disputes in the transition period, as well as the differences in the influence of entrepreneur's political identity and institutional environment. By using the sample survey data of national private enterprises, it is found that the dispute resolution approaches chosen by enterprises are diversified, and the enterprises with political relations are more willing to resort to the national dispute resolution mechanism of "court arbitration" and "government channels". In a more "poor" environment, politically connected companies tend to opt for legal action rather than government channels. In addition, political relations help to improve ex post-satisfaction in dispute resolution, and this effect is greater under the "poor" system.
