论自然权利的证成及来自历史主义的挑战

【摘要】：自然权利学说在西方政治哲学史上占有重要地位,这一学说主张人们基于理性拥有生命、自由、财产和反抗暴政的权利,构成了自由民主政治的核心原则。通常认为,由于历史主义等现代观念的兴起,自然权利学说渐被视为缺乏科学性的"形而上学"。然而,历史主义并未成功地否定自然权利学说。历史学派——历史主义的第一阶段,认为权利是历史地形成的,这与认为权利的最终根基在于理性的自然权利观念是可以并行不悖的。激进历史主义——历史主义的第二阶段,认为一切观念都是历史的,也就不可能存在什么自然权利。对此,自然权利可以从理性目的论得到支持。
[Abstract]:The theory of natural rights plays an important role in the history of western political philosophy. This theory advocates that people own life, freedom, property and the right to resist tyranny based on reason, which constitutes the core principle of liberal and democratic politics. It is generally believed that due to the rise of modern concepts such as historicism, the theory of natural rights is gradually regarded as lack of scientific metaphysics. However, historicism has not succeeded in denying the theory of natural rights. In the first stage of historicism, the historical school holds that the right is historically formed, which can go hand in hand with the idea that the ultimate foundation of the right lies in the rational concept of natural rights. Radical historicism-the second stage of historicism that all ideas are historical and there can be no natural rights. In this regard, natural rights can be supported by rational teleology.
