中国语境下“普遍性”概念的生成——以权利的“普遍性”论证为例

【摘要】：考察普遍权利在中国学界的论证进路,辨析权利观念和文化传统的互动关系,是理解中国语境下"普遍性"概念如何产生发展的重要切入点。首先,梁启超在全面批评儒家传统的基础上,以国家主义为根据,论证权利的"普遍性"。其次,牟宗三和赵汀阳都试图从中国传统中发展出规范性的"普遍性"理论,却未能将传统变为论证普遍权利的有效资源。最后,中国学界的建构论拒绝了文化本质主义的"普遍性"概念,同时让传统有条件地参与到普遍权利的论证中。
[Abstract]:It is an important entry point to understand how the concept of "universality" comes into being in Chinese context by examining the argumentation of universal rights in Chinese academic circles and analyzing the interactive relationship between the concept of right and cultural tradition. First, on the basis of comprehensive criticism of Confucian tradition and nationalism, Liang Qichao demonstrates the universality of rights. Secondly, both Mou Zongsan and Zhao Tingyang tried to develop the normative "universality" theory from the Chinese tradition, but failed to turn the tradition into an effective resource to demonstrate universal rights. Finally, the constructivism of Chinese academic circles rejects the concept of "universality" of cultural essentialism and allows tradition to participate in the argumentation of universal rights conditionally.
