代议制形成中的政策问题建构权

【摘要】：在代议制生成的过程中,政策问题建构主体经历了与代议制框架相适应的重建过程。但是,代议制使政策问题建构出现了双重分化:第一,代议制赖以建立的代表与被代表关系造成了政策建构主体的分化,虽然公民还是政策问题建构权的拥有者,但是,当公民转化为被代表者的时候,实际上是把政策问题建构权委托给了他们所选举的代表了。第二,代表从选民那里获取的政策问题建构权在进入议会的时候,是以提案权的形式出现的,表现出了与立法权的不同,从而在政策问题建构中出现了两种不同的权力。由于政策问题建构中出现了这两重分化,引发了政策问题建构权的异化,也同时开始走向与启蒙时期民主理想背离的方向。
[Abstract]:In the process of the generation of representative system, the subject of policy problem construction has experienced the reconstruction process adapted to the framework of representative system. However, the representative system makes the policy construction appear double differentiation: first, the representative and the representative relations that the representative system depends on cause the division of the policy construction subject, although the citizen is still the holder of the policy problem construction right, but, When citizens transform themselves into representatives, they actually delegate the right to construct policy issues to their elected representatives. Second, when the representative obtains the right to construct policy issues from the voters, it appears in the form of proposal power when entering the parliament, which shows the difference from the legislative power, thus there are two kinds of different powers in the construction of policy issues. Due to the double differentiation in the construction of policy problems, the alienation of the right to construct policy problems has been initiated, and at the same time, it has started to deviate from the democratic ideal in the Enlightenment period.
