以佛光山为例考察佛教在罪犯矫正中的应用

【摘要】：西方国家对罪犯的宗教教诲传统由来已久,宗教发挥教化罪犯的作用,根源于基督教的救赎理念。中国历史上的狱制深受儒家思想影响,呈现出惩罚与教化并重的特色。民国时期,受西方狱制影响,中国监狱里兴起了宗教教诲的高潮,台湾地区继承并发展了这一传统。本文拟以佛光山为例,分析佛教在罪犯矫正中的作用,并进一步探讨大陆佛教进入监狱教化罪犯所面临的机遇和挑战。本论文主要分为五部分。第一章是对西方国家监狱里宗教教诲传统的介绍,分析西方国家狱制特色,会发现宗教教诲在罪犯矫正中占有较大比重,基督教的核心思想是"原罪",这让"拯救"和"救赎"成为罪犯改造的重要理念;第二章概述了中国历史上监狱内的感化教育,受儒家思想的深远影响,中国古代行刑呈现出惩罚与教化并重的双重性格,儒家"德主刑辅"的理念,强调道德教化的力量,这为民国狱政改革积极引进西方监狱的宗教教诲,提供了历史文化土壤、提高了民众心理接受度;第三章描述了台湾地区对民国宗教教诲传统的继承和发展,以佛光山为例分析了其监狱布教的特点:布教持续时间长、范围广、方式多种多样、教诲效果显著;第四章通过分析佛光山监狱布教,明确宗教教诲得以在监狱施行,政府、狱方、宗教团体、罪犯四者缺一不可,唯其通力合作,方能实现宗教在监狱矫治中的作用,这为佛教监狱教化在大陆的应用提供了一个成功范例。第五章作为文章的结尾,主要思考了佛教监狱教诲在大陆的应用前景。本论文所进行的学术探索具有一定的现实意义,结合今日大陆国情与狱制现状,佛教进入监狱对罪犯实施教诲,一方面面临严峻的挑战,这就需要我们借鉴佛光山在监狱布教方面的经验和教训;另一方面也出现了诸多机遇,这意味着佛教在大陆社会福利领域可以开辟出新的发展途径。
[Abstract]:The tradition of religious education of criminals in western countries has a long history. Religion plays a role of enlightening criminals, rooted in the Christian concept of redemption. The penitentiary system in Chinese history was deeply influenced by Confucianism and showed the characteristics of equal emphasis on punishment and education. During the period of the Republic of China, under the influence of the western prison system, a climax of religious instruction arose in Chinese prisons, and Taiwan inherited and developed this tradition. Taking Foguang Mountain as an example, this paper analyzes the role of Buddhism in the correction of criminals, and further discusses the opportunities and challenges faced by Buddhism in entering prisons to educate criminals. This paper is divided into five parts. The first chapter is an introduction to the tradition of religious education in the prisons of western countries. By analyzing the characteristics of the prison system in western countries, we will find that religious education occupies a large proportion in the correction of criminals. The core thought of Christianity is "original sin", which makes "salvation" and "salvation" an important idea for the reform of criminals. The second chapter outlines the reformatory education in prisons in the history of China, which is deeply influenced by Confucianism. In ancient China, punishment showed a dual character with equal emphasis on punishment and education. The Confucian concept of "virtue dominates punishment and auxiliary punishment" emphasizes the power of moral education, which provides the historical and cultural soil for the reform of prison administration in the Republic of China to actively introduce the religious teachings of western prisons, and to provide the historical and cultural soil for the reform of prison administration in the Republic of China. The third chapter describes the inheritance and development of the religious tradition of the Republic of China in Taiwan, taking Foguang Shan as an example to analyze the characteristics of its prison teaching: long duration, wide range, and various ways. The fourth chapter, by analyzing the teaching in Foguang Shan Prison, makes it clear that religious education can be carried out in the prison. The government, the prison authorities, religious groups and criminals are indispensable, only if they cooperate with each other. Only then can religion play a role in prison correction, which provides a successful example for the application of Buddhist prison education in mainland China. The fifth chapter as the end of the article, mainly thinking about the application of Buddhist prison education in the mainland. The academic exploration carried out in this paper has certain practical significance. According to the current situation of the mainland and the prison system today, Buddhism enters the prison to carry out the education to the criminals. On the one hand, it faces severe challenges. This requires us to draw lessons from Foguang Shan's experience and lessons in prison teaching. On the other hand, there are many opportunities, which means that Buddhism can open up a new way of development in the field of social welfare on the mainland.
