我国网络购物消费者权益法律保护研究

【摘要】:随着电子商务的迅猛发展,网络购物悄然兴起,为消费者提供了一条全新的购物途径,越来越多的消费者也将其作为日常消费方式的首选。但是网络购物在带给消费者便捷消费的同时,其固有的虚拟性、开放性、高风险性也增加了交易风险,使购物关系变得复杂化,消费者权益易受到侵害。故本文以网络购物环境为背景,研究消费者权益法律保护的问题。由于我国相关的网络购物消费者权益法律立法体系不完善、监管不到位、经营者与消费者信息不对称等原因,致使在网络购物环境中消费者权利得不到有效的保护,网络购物欺诈、虚假宣传、无效合同、消费者信息泄露等事件频有发生,所以对网络购物消费者权益的保护变得尤为重要。知情权是消费者权利中的基础权利,消费者信息获取不全面将直接影响交易效果,对此应完善经营者的在线信息披露的义务,缩小交易双方信息不对称的局面,使消费者充分掌握交易内容,实现知情权。隐私权关系到消费者的个人信息资料及财产安全问题,对网络购物消费者隐私权的保护,一方面要加强经营者自律和政府监管;另一方面要完善隐私权的法律保护,确认网络隐私权具有独立人格的法律地位,明确隐私权内容。反悔权作为一项售后保障权利,为消费者提供了特别保护,凸显了法律的人性化。对反悔权的保护还需进一步细化有关法律的规定,需明确不适宜退货的范围及退货流程。此外,在实践中,网络购物消费者权益纠纷问题日显复杂化,司法审判中诉讼证据收集困难、侵权关系难以认定、欠缺有效的纠纷解决途径,争议纠纷得不到及时有效的解决等原因都使消费者维权变得困难重重。故笔者对传统诉讼中举证责任、法院管辖的规定做了重新探讨,提出了个人修改意见。并有针对性的列举了司法途径之外的争议解决方式,如建立在线争议与小额诉讼的救济制度。
[Abstract]:With the rapid development of electronic commerce, online shopping rises quietly, which provides a new way for consumers to buy. More and more consumers also take it as the first choice of the daily consumption mode. But the online shopping brings consumers convenient consumption at the same time, its inherent virtual, open, high risk also increases the transaction risk. Make the shopping relationship become more complicated, consumer rights and interests are vulnerable to infringement. Therefore, this paper takes the network shopping environment as the background. Research on the legal protection of consumer rights and interests. Due to the relevant legal system of online shopping consumer rights and interests of our country is not perfect, supervision is not in place, operators and consumers information asymmetry and other reasons. In the online shopping environment, consumers' rights can not be effectively protected, online shopping fraud, false publicity, invalid contracts, consumer information leakage and other incidents occur frequently. Therefore, the protection of consumers' rights and interests of online shopping has become particularly important. The right to know is the basic right of consumers, and the incomplete acquisition of consumer information will directly affect the effect of transactions. Therefore, we should perfect the obligations of online information disclosure of the operators, reduce the situation of asymmetric information between the two sides of the transaction, and enable consumers to fully grasp the content of the transaction. To realize the right to know, the right to privacy is related to the consumer's personal information, information and property safety. On the one hand, it is necessary to strengthen the self-discipline of the operator and the government supervision to protect the privacy of the online shopping consumer. On the other hand, we should perfect the legal protection of the right of privacy, confirm the legal status of the right of network privacy with independent personality, and make clear the content of the right of privacy. As a right of protection after sale, the right of retrogression provides special protection for consumers. Highlight the humanization of the law. The protection of the right to reverse the need to further refine the provisions of the law, need to clarify the scope of unsuitable return and return process. In addition, in practice. Online shopping consumer rights and interests disputes become more and more complicated, judicial trial litigation evidence collection difficulties, tort relations are difficult to identify, the lack of effective dispute resolution. Disputes can not be resolved in a timely and effective manner, and other reasons make consumer rights protection become difficult. Therefore, the author of the traditional litigation in the burden of proof, the court jurisdiction of the provisions have been re-discussed. The author puts forward a personal amendment opinion, and lists the dispute settlement methods outside the judicial channels, such as the establishment of online dispute and small claims relief system.
