【摘要】：维护世界和平与维持国际局势的稳定是世界各国的共同发展目标。近年来,频发于世界各地的恐怖活动使得反恐成为全球性的热点话题,尤其是9·11事件的发生使得国际社会认识到恐怖主义的危害性,因此国际间开始形成合作反恐的共识。为有效打击恐怖主义,充分发挥国际反恐行动的积极作用,对国际反恐行动进行研究是十分必要的。本文将国际反恐行动作为研究对象,通过文献分析法和比较分析法,找出其在制度构建、实践应用层面的漏洞,如立法存在空白、与国际法部分原则与制度存在冲突等,并从理论与实证角度对这些问题进行分析,同时提出完善建议。本文除结语外分为六个部分。本文的第一部分阐明了本文研究国际反恐问题的背景,介绍了当前学界对国际反恐的研究现状。第二部分以国际法基本原则中的国家主权平等原则与禁止使用武力原则为切入点,以国际反恐行动与国际法基本原则的关系为线索,探讨了越境打击与武力反恐在国际法框架下引发的争议。近年来,随着国际反恐力度的不断加强,反恐行动与国际法基本原则之间的关系成为国际社会的讨论热点。第三部分论述了国际反恐立法面临的挑战,并结合反恐现状指出了国际反恐立法的发展趋势。通过概述现有国际公约、美国立法、欧盟部分国家的立法及我国立法中关于反恐的规定,总结出当前国际反恐立法的不足,并从形式与内容角度提出完善国际反恐立法体系的建议。第四部分通过对人权保护的关注,分析了国际反恐行动在具体实施过程中与人权保护的矛盾和协调。一些国家一味强调打击恐怖主义,但忽视了部分反恐手段造成了对人权的侵犯。该部分强调反恐方式与人权保护的平衡。第五部分讨论了国际反恐行动与引渡制度的关系。作为国际合作的重要方式,引渡制度应当在国际反恐领域充分发挥联络各国关系的作用。第六部分阐述了国家责任制度在国际反恐行动中的作用与局限,并据此提出提高该制度在国际反恐领域效力的建议。国家责任制度是规范各国实施反恐措施、履行反恐义务的重要制度。通过总结该制度在国际反恐领域的局限,对其提出完善建议。
[Abstract]:Maintaining world peace and maintaining the stability of the international situation is the common development goal of all countries in the world. In recent years, frequent terrorist activities around the world have made anti-terrorism a global hot topic. Especially the 9 路11 events made the international community realize the harmfulness of terrorism, so the international community began to form a consensus of cooperation in anti-terrorism, in order to effectively combat terrorism. It is very necessary to give full play to the positive role of international action against terrorism, and it is very necessary to study international action against terrorism. This paper takes international action against terrorism as the object of study, through the method of literature analysis and comparative analysis. Find out its system construction, practical application of loopholes, such as gaps in legislation, and some principles of international law and institutional conflict, and from the theoretical and empirical perspective to analyze these issues. Besides the conclusion, this paper is divided into six parts. The first part of this paper clarifies the background of the study of international counter-terrorism. The second part focuses on the principle of sovereign equality of states and the prohibition of the use of force in the basic principles of international law. Based on the relationship between international anti-terrorism actions and the basic principles of international law, this paper probes into the controversy between cross-border strike and force anti-terrorism under the framework of international law. In recent years, with the strengthening of international anti-terrorism efforts. The relationship between anti-terrorism actions and the basic principles of international law has become a hot topic in the international community. The third part discusses the challenges faced by international anti-terrorism legislation. It also points out the development trend of international anti-terrorism legislation by summarizing the existing international conventions, American legislation, the legislation of some European Union countries and the provisions on counter-terrorism in our country's legislation. Summed up the current international anti-terrorism legislation deficiencies, and from the form and content of the international anti-terrorism legislation system to improve the recommendations. 4th through the protection of human rights. The contradiction and coordination between the international anti-terrorism action and the human rights protection in the concrete implementation process are analyzed. Some countries always emphasize the fight against terrorism. This part emphasizes the balance between counter-terrorism methods and human rights protection. Part 5th discusses the relationship between international counter-terrorism actions and extradition regime. Style. Extradition system should give full play to the role of liaison between countries in the field of international counter-terrorism. Part 6th describes the role and limitations of the system of State responsibility in international counter-terrorism action. Based on this, the author puts forward some suggestions to improve the effectiveness of the system in the field of international counter-terrorism. The system of State responsibility is to regulate the implementation of counter-terrorism measures by States. By summing up the limitations of this system in the field of international terrorism, the author puts forward some suggestions for its perfection.
