新常态下我国知识产权边境措施完善问题研究

【摘要】：知识产权边境措施对防范和制止国际贸易进出口环节的知识产权侵权行为发挥了重要作用,世界各国也越来越重视对知识产权边境措施的运用与研究。我国知识产权边境措施主要依据《中华人民共和国知识产权海关保护条例》。经历二十多年发展,当我国对外贸易总额超越美国成为世界第一、知识产权对经济发展的支点作用不断增强时,我国知识产权边境措施逐渐无法满足经济社会发展需要,存在保护范围不合理、维权启动程序不便捷、执法程序不规范、执法方式不灵活、海关保护与刑事保护衔接不够有效等问题,亟需完善相关制度,提升知识产权边境措施效能。本文对我国知识产权边境措施现状进行评价,分析域外知识产权边境措施主要制度,立足基本国情,提出了调整保护范围、降低启动条件、规制权利滥用、增加执法方式、规范强制措施、促进海关保护与刑事衔接等六个方面建议,特别是在规范强制措施和扩大实施主体方面进行了创新性探索,以求对我国知识产权边境措施的完善起到积极作用,进一步提高知识产权边境措施保护水平,从而更好保障知识产权人的合法权益,维护社会公共利益,促进对外贸易健康稳定发展。
[Abstract]:The intellectual property border measures have played an important role in preventing and suppressing intellectual property infringement in international trade and import and export links. More and more countries in the world also attach importance to the application and research of intellectual property border measures. China's intellectual property border measures are mainly based on the regulations of the people's Republic of China on Customs Protection of intellectual property. They have experienced more than 20 years of development. When China's total foreign trade exceeds the United States to become the first in the world and the fulcrum of intellectual property rights plays an increasing role in economic development, China's intellectual property border measures are gradually unable to meet the needs of economic and social development, and the scope of protection is unreasonable. Such problems as not convenient procedures for safeguarding rights, irregular procedures for enforcing laws, inflexible methods of law enforcement, insufficient link between customs protection and criminal protection, and so on, are in urgent need of improving the relevant systems. This paper evaluates the present situation of China's intellectual property border measures, analyzes the main systems of extraterritorial intellectual property border measures, and puts forward the adjustment of the scope of protection and the reduction of start-up conditions, based on the basic national conditions. Six suggestions, such as regulating abuse of rights, increasing law enforcement methods, standardizing coercive measures, promoting customs protection and criminal connection, are proposed, especially in the aspects of standardizing coercive measures and expanding the subject of implementation. In order to play a positive role in the improvement of our country's intellectual property border measures, and further improve the level of protection of intellectual property border measures, so as to better protect the legitimate rights and interests of intellectual property owners and safeguard the social and public interests, Promote the healthy and stable development of foreign trade.
