德化县土地执法监察问题研究

【摘要】：土地关系到我国社会稳定与经济可持续的发展。在对土地进行管理和土地市场秩序进行维护整治的过程中,土地执法监察是非常重要的手段和工具。随着城市化进程的不断推进,经济发展与土地使用的矛盾日益突出,违法用地现象频发,土地执法监察也陷入了“发现难、查处难、执法难”的困境,如何破解这种情况变得十分重要。本文在前人研究的基础上,结合工作实际,运用公共管理知识从多个角度分析当前德化县土地执法监察现状,指出其中存在的问题及其原因。通过分析,并吸取国内土地执法监察先进经验,本文提出德化县土地执法监察存在问题的一些对策建议,一是加强土地执法监察法律制度的建设,包括加大土地管理法律法规宣传力度和完善相关土地执法监察法律法规;二是改革现有国土资源管理体制,包括实行国土资源部门完全垂直管理,保持土地执法监察独立性,建立省内土地督察制度;三是加强土地执法监察联动机制、动态巡查责任机制、全民参与监督机制、违法用地通报公示机制、队伍考核机制、执法监察表彰激励机制等相关机制的建设;四是疏堵结合,改革违法用地处理方式。基层土地执法监察工作是国土资源管理的基础和前提,本文探讨研究德化县土地执法监察之困与解决之道,希望对整个国土资源执法监察体系具有一定的启示作用。
[Abstract]:Land is related to the social stability and sustainable economic development of our country. In the process of land management and land market order maintenance and renovation, Land law enforcement and supervision is a very important means and tool. With the development of urbanization, the contradiction between economic development and land use is increasingly prominent, the phenomenon of illegal land use occurs frequently, and the supervision of land law enforcement also falls into "difficult to find, investigate and deal with." How to solve this situation has become very important. On the basis of previous studies and combined with the work practice, this paper analyzes the present situation of land law enforcement and supervision in Dehua County from many angles by using public management knowledge. This paper points out the existing problems and their causes. By analyzing and drawing on the advanced experience of land law enforcement and supervision in China, this paper puts forward some countermeasures and suggestions for the existing problems of land law enforcement supervision in Dehua County. First, to strengthen the construction of the legal system of land law enforcement and supervision, including increasing the publicity of land management laws and regulations and to improve the relevant laws and regulations on land law enforcement and supervision; and second, to reform the existing land and resources management system. Including the implementation of complete vertical management of land and resources departments, the maintenance of the independence of land law enforcement and supervision, and the establishment of a land supervision system in the province; third, strengthening the linkage mechanism of land law enforcement and supervision, the mechanism of dynamic inspection responsibility, and the participation of the whole people in the supervision mechanism. The construction of related mechanisms, such as the mechanism of public notification of illegal land use, the mechanism of team assessment, the mechanism of law enforcement, supervision and recognition, and the incentive mechanism; fourth, the combination of dispersing and blocking, It is the foundation and premise of land resources management to reform the illegal land disposal mode. This paper discusses the difficulties and solutions of land law enforcement and supervision in Dehua County. Hope to the entire land and resources law enforcement supervision system has certain enlightenment function.
