转型期网络谣言的刑法规制研究

【摘要】：网络谣言是一种客观存在,是互联网发展到一定阶段的必然产物。由于网络的虚拟性和隐蔽性,兼具了传统的大众传播之单向和人际传播的双向传播特性的网络传播,其传播速度和广度必然得到更大提升,因网络交流的匿名性,网络谣言在传播中既难溯源也难控制,必然对于社会构成巨大危害。转型期的社会形势下,各种社会矛盾交织,网络谣言的盛行既不利于社会秩序的良性运行,对于法制建设和公民权益的保护也必然构成一种侵害。目前,刑法在规制网络谣言犯罪中,仍然存在诸多不足,诸如罪名体系不完善、标准不明确、定刑不合理等问题依然存在。在社会转型期的形势下,从刑法规制的角度论述网络谣言治理中存在的立法和司法问题,具有一定的理论意义和现实意义。通过运用文献研究法、理论研究法和解释学方法,本文对网络谣言展开理论分析的基础上,重点对于刑法和两高最新出台的《解释》中对于网络谣言规制进行了梳理,结合当前转型期网络谣言出现的新情况,从立法、司法解释、司法实践层面分析了刑法在规制网络谣言中的现状与问题,并提出了改进对策。本文在研究中,主要分为五个部分:其一,绪论部分,主要论述研究背景及意义、研究现状以及本文的研究方法与创新之处。其二,网络谣言刑法规制的基本理论,论述我网络谣言的概念和特征,对于网络谣言的刑法认定和刑法规制方法进行了阐述。其三,转型期网络谣言刑法规制的特殊性,结合转型期的形势分析了网络谣言的特点,阐述了其危害性和当前的主要问题。其四,转型期网络谣言刑法规制现状及问题,从立法层面和司法解释层面,总结了现有的有关网络谣言的立法,分析了其不足。同时,论述了司法实践中存在的难题和困境。其五,转型期网络谣言刑法规制的改进,结合存在的问题,从立法、司法解释和司法实践的角度提出了改进对策。
[Abstract]:Network rumor is a kind of objective existence, which is the inevitable result of the development of the Internet to a certain stage. Because of the virtual and hidden nature of the network, it has the characteristics of the traditional one-way communication of mass communication and the two-way transmission of interpersonal communication. Because of the anonymity of the network communication, it is difficult to trace the source and control the network rumors in the communication, which is bound to pose a great harm to the society. Under the social situation in the transition period, various social contradictions interweave. The prevalence of network rumors is not only harmful to the healthy operation of social order, but also to the construction of legal system and the protection of citizens' rights and interests. At present, the criminal law still has many shortcomings in regulating the crime of network rumor. Problems such as imperfect charge system, unclear standard and unreasonable punishment still exist. In the situation of social transformation, this paper discusses the legislative and judicial problems existing in the governance of network rumors from the angle of criminal law regulation. Through the use of literature research method, theoretical research method and hermeneutics method, based on the theoretical analysis of network rumors, Focusing on the criminal law and the most recent interpretation of the "interpretation" of the Internet rumor regulations were combed, combined with the current transition period of the new situation of Internet rumors, from the legislative, judicial interpretation, This paper analyzes the current situation and problems of criminal law in regulating network rumors, and puts forward some countermeasures. In the research, this paper is divided into five parts: first, the introduction part, mainly discusses the background and significance of the research. Second, the basic theory of the criminal law regulation of the network rumor, the concept and characteristic of my network rumor, the criminal law cognizance and the criminal law regulation method of the network rumor. The particularity of the criminal law regulation of network rumor in the transition period, combined with the situation in the transition period, this paper analyzes the characteristics of the network rumor, expounds its harmfulness and the main problems at present. 4, the present situation and problems of the criminal law regulation of the network rumor in the transition period. From the aspects of legislation and judicial interpretation, this paper summarizes the existing legislation on network rumor, analyzes its shortcomings, and discusses the problems and difficulties in judicial practice. Fifth, the improvement of the criminal regulation of network rumor in the transitional period. Combined with the existing problems, this paper puts forward the improvement countermeasures from the angle of legislation, judicial interpretation and judicial practice.
