多中心治理理论框架下北京市消费维权体系的构建研究

【摘要】：消费是人们生活必不可少的,而消费安全不仅影响着人们的身心健康、经济的健康发展及社会治安的稳定,更影响着政府和国家的整体形象。以往有很多学者已经将多中心治理的理论运用到食品安全、药品监管等研究上了,而本文则是以北京市消费维权体系为研究对象,运用多中心治理理论,通过文献研究、案例研究、对比研究等多种方法对北京市消费维权体系的现状进行分析,对体系中存在的侵权问题进行全面且透彻的分析。在对比国内外相关消费维权文献的基础上,分析北京市消费维权的发展和现状,并构建出北京市消费维权体系。首先,本文从立法层面、司法层面、行政保护、行业自律以及社会监督等五个方面对北京市的消费维权体系进行了现状的分析。然后本文在多中心治理理论的框架下,重新构建了从政府、企业、行业协会、消费者、媒体等多元主体共同参与下的北京市消费维权体系。为北京市消费维权体系的构建和完善提供新的视角和理论基础,在实践中也可以促进北京市消费者维权秩序的健康发展,促使北京市消费市场的安全有序运行。本文主要分为六个章节:第一章是绪论部分,首先通过对北京市经济、消费情况的介绍引出本论文的写作背景,然后对有关的文献综述做出了概括和总结,在最后的部分说明了本文写作所使用的研究方法、研究路线以及写作框架;第二章是相关概念和理论基础,对有关核心概念和本文要运用的理论依据进行了阐述,为本文的写作奠定一定的理论基础;第三章是北京市消费维权的发展和现状,对北京市消费维权体系的发展和现状进行分析和说明,总结出在不同时期北京市消费维权的状况;第四章是北京市消费维权体系存在的问题及原因分析,在问题中,从消费者权益法律保障、行政保护、司法救济途径、行业协会自律体系与企业经营者自律经营、社会监督、教育引导等方面进行了阐述,然后根据这些问题分别做出相应的原因分析;第五章是基于多中心理论框架下对北京市消费维权的构建,分别从政府、企业经营者、行业协会、消费者等主体进行的构建,并将社会监督贯穿于整个体系中,最后分析了消费维权体系中的这些主体之间的互动关系;第六章是结论,主要是对本文的主要内容进行了总结,对论文存在的不足进行了阐述,最后对本文进行了后期的展望。
[Abstract]:Consumption is necessary to our life, and consumer safety not only affects people's physical and mental health, the healthy development of the economy and the stability of social order, but also affect the overall image of the government and the country. There are a lot of scholars have the multi center governance theory to the study of food safety, drug supervision and so on, but this is the is the consumer rights protection system in Beijing city as the research object, the use of multi center governance theory, research through literature research, case study, comparative study and other methods on the situation of consumer rights protection system in Beijing city is analyzed, comprehensive and thorough analysis on the problems existing in the tort system. Based on the comparison of domestic and foreign literature related to consumer rights on the development and present situation analysis of Beijing consumer rights, and construct Beijing city consumer rights system. Firstly, this paper from the aspect of legislation, judicature, administrative protection, industry Self-discipline and social supervision in five aspects to the Beijing consumer rights system for the analysis of the present situation. Then based on the framework of polycentric governance theory, constructs from the government, enterprises, consumers, industry associations, media and other multiple subjects to participate in the Beijing consumer rights system to construct and provide new. The Perspective and theoretical basis for improving consumer rights protection system in Beijing City, in practice also can promote the healthy development of Beijing city consumer rights order, promote Beijing city consumer market safe and orderly operation. This paper is divided into six chapters: the first chapter is the introduction part, first through to the Beijing city economy, consumption of the introduction the background of this thesis, and then the relevant literature review and make a summary and conclusion in the last part of the research methods used in writing this paper, the research route and The writing framework; the second chapter is the related concepts and theories of the core concepts and the theoretical basis of using were introduced, laying a theoretical foundation for the writing of this article; the third chapter is the development and the status quo of Beijing city consumer rights, analyzes and illustrates the development and current situation of consumer rights protection system in Beijing city. Summed up the consumer rights in the Beijing city in different periods; the fourth chapter is the analysis of problems and reasons of Beijing city consumer rights protection system, in the problem, from the legal protection of consumers' rights and interests, administrative protection, judicial relief way, industry associations and self-discipline system and enterprise self-discipline management, social supervision, education and other aspects of the this, according to these problems respectively analyzes the corresponding reasons; the fifth chapter is based on the construction of the Beijing consumer rights under the framework of multi center, separately from the government, Business operators, industry associations, consumers and other construction subject, and social supervision throughout the system, finally analyses the interactive relationship between the consumer rights system in the body; the sixth chapter is the conclusion, mainly is the main contents of this paper are summarized and the deficiencies of this paper are described. At the end of this paper the prospect.
