社会工作介入社区矫正问题探究

【摘要】：我国社区矫正制度从2002年开始试点,发展到如今已经走过15个年头,社区矫正要办的好,不能仅靠政府大包大揽,还需要更多社会力量的参与。社会工作在我国的发展势头迅猛,已成为社会治理中的一支不可或缺的力量。当前迫切需要社工机构和大量社会工作者投入到社区矫正工作当中去,因为社区矫正需要社会工作的价值理念和专业的工作方法,社会工作的价值理念和社区矫正的目标是契合的,社会工作的专业工作方法运用到社区矫正中具有其他学科所没有的突出优势。这是由社会工作的专业特性所决定的。社会工作介入社区矫正虽已有一些实践,取得了一些进展,但也出现了一些问题。本文围绕社会工作介入社区矫正领域的现状以及存在的问题及发展对策展开研究。全文分为四个部分,第一部分,阐述社会工作介入社区矫正问题研究的研究背景与意义。研究背景包括我国社区矫正制度的发展历程、社会工作介入社区矫正的实践及存在的问题值得关注。研究意义包括三个方面,有利于社区矫正制度的完善,切实的帮助到被矫正人员,使其真正回归到正常的社会生活中。也有利于社区的和谐稳定。同时,对学界研究的与社有关社会工作与社区矫正的研究文献进行总结归纳。第二部分,有关概念界定及理论基础。首先,通过阅读大量文献对比较重要的有关概念进行界定,如社区矫正、矫正社会工作、社区矫正社会工作等相关概念。其次,对相关理论基础进行论述,包括社区矫正法学方面的理论以及矫正社会学方面的理论。社区矫正法学理论基础有教育刑论、刑法谦抑主义思想、刑法经济性原则等。第三部分,社会工作介入社区矫正的现状和问题。选取几个典型地域,通过实地调查和对有关人员进行访谈,获得第一手资料。进而研究论述我国落后地区和发达地区社会工作介入社区矫正的发展现状,指出落后地区虽然暂无社会工作者直接参与到社区矫正工作当中,但有部分志愿者通过学习掌握社会工作价值理念和工作方法,尝试着将之运用到社区矫正工作中。发达地区社会工作介入社区矫正有两种方式,一种是政府聘用社工人才加入到社区矫正工作队伍,一种是政府购买专业社工机构的服务。通过研究社会工作介入到社区矫正的现状,进而从财政保障、政策法规、人才引进等宏观层面以及具体的社工介入社区矫正实务的微观层面来对社会工作介入社区矫正所出现的问题进行分类把握。第四部分,完善社会工作介入社区矫正的建议。通过前文诊断出的社会工作介入社区矫正的疑难杂症,最终提出一些具有针对性的切实可行的建议。认为下一步在完善相关法律法规,设立垂直专项资金,保障社工人才队伍等方面均大有可为。
[Abstract]:The community correction system of our country began to pilot from 2002, and has now gone through 15 years. The community correction should be done well, and the government should not do it in a big way. More social forces are needed. Social work is developing rapidly in our country. Social work institutions and a large number of social workers are urgently needed to put into the community correction work, because community correction needs the value concept of social work and professional working methods. The value concept of social work is in line with the goal of community correction. The application of professional methods of social work to community correction has outstanding advantages that other disciplines do not have. This is determined by the professional characteristics of social work. Although social work has been involved in community correction, it has made some progress. But there are also some problems. This paper focuses on the current situation of social work intervention in the field of community correction and the existing problems and development countermeasures. The paper is divided into four parts, the first part, This paper expounds the research background and significance of social work intervention in community correction. The research background includes the development of community correction system in China. The practice and problems of social work intervention in community correction are worthy of attention. The research significance includes three aspects, which are conducive to the improvement of the community correction system, and to the correction personnel. It is also beneficial to the harmony and stability of the community. At the same time, the literature on social work and community correction in academic circles is summarized and summarized. The second part, First of all, through reading a lot of literature to define the more important concepts, such as community correction, correction of social work, community correction of social work and other related concepts. The related theoretical basis is discussed, including the theory of community correction law and the theory of correction sociology. The theoretical basis of community correction law includes the theory of educational punishment, the thought of modesty of criminal law, the economic principle of criminal law and so on. The third part, The current situation and problems of social work intervention in community correction. Selected several typical areas, through field investigation and interviews with relevant personnel, Obtaining firsthand data, and then studying and discussing the current situation of social work intervention in community correction in backward and developed areas of our country, pointing out that although no social workers are directly involved in community correction work in backward areas for the time being, However, some volunteers try to apply it to community correction by learning to grasp the value concept and working methods of social work. There are two ways for social work to intervene in community correction in developed areas. One is that the government employs social workers to join the work force of community correction, the other is that the government buys the services of professional social work institutions. By studying the current situation of social work, social work is involved in community correction, and then from the perspective of financial security, policies and regulations, At the macro level such as the introduction of talents and the microcosmic level of social worker intervention in community correction practice, the problems arising from social work intervention in community correction are classified and grasped. Part four, The suggestion of perfecting social work intervention in community correction. Through the diagnosis of social work intervention in community correction, finally put forward some practical and pertinent suggestions. We think that the next step is to perfect the relevant laws and regulations. The establishment of vertical special funds, social workers and other aspects of the protection of talent are promising.
