我国老年人精神赡养的法律保护问题研究

【摘要】：随着物质生活水平不断提高,老年人的温饱问题基本上得到解决,对精神生活的向往和追求也变得越来越强烈。经济发展也带来社会家庭环境的变迁,老年人孤独终老的凄凉现象时有发生。我国老龄化速度的加快,老年人的精神需求问题成为国家和社会不可回避问题。老年人状告子女已不再是新鲜事,但原先的法律对此类案件的处理几乎没有相关规定,精神赡养诉求因于法无据大多数得不到法院的支持,原先的法律对老年人权益保护的相关规定已不能满足现实的需要。2013年新修订的《老年人权益保护法》正式施行,关于保护老年人的精神权益问题成为社会讨论的焦点问题,对“常回家看看”引进法律是否得当,是否已经逾越了法律与道德的界限,在实践中又如何解决操作难等问题。新法的颁布自当经过立法者的慎重考虑,有其存在的意义和价值。从近些年关于此类案件的处理数量和处理结果可以看出,新法并不只是个花瓶条款,它在改变现代人的观念上以及纠纷处理上是起到一定作用的。但新法对于精神权益的保护的规定仍然不够全面,缺乏系统的研究,在具体的实践环节缺乏可操作性。法律如何保障无形的精神权益,尚需探索和研究。正是因为这一层面的理论价值和实践价值才有了本文选题的意义。本文对精神赡养这一问题进行深入剖析,分析了我国精神赡养的现状以及当前的法律规定,并参考国外先进的立法理论和实践经验,结合我国国情,提出完善法律对精神赡养的保护一些建议。
[Abstract]:With the improvement of material life, the problem of food and clothing for the elderly is basically solved, and the yearning and pursuit of spiritual life become more and more intense. Economic development also brings about the changes of social family environment, and the desolate phenomenon of old people dying alone occurs from time to time. With the acceleration of aging in China, the spiritual needs of the elderly have become an unavoidable problem for the country and society. It is no longer new for the elderly to sue their children, but there is little provision for the handling of such cases in the original law, and the majority of spiritual support claims are not supported by the courts because of lack of law. The original law on the protection of the rights and interests of the elderly can no longer meet the actual needs. In 2013, the newly revised Law on the Protection of the Rights and interests of the elderly came into effect, and the issue of protecting the spiritual rights and interests of the elderly has become the focus of social discussion. To "often go home" to see if the introduction of laws is appropriate, whether it has crossed the legal and moral boundaries, and how to solve the problem in practice, such as difficult to operate. The promulgation of the new law should be carefully considered by the legislator and has its significance and value. It can be seen from the number and result of handling such cases in recent years that the new law is not only a vase clause, but also plays a certain role in changing the concept of modern people and handling disputes. However, the provisions of the new law on the protection of spiritual rights and interests are still not comprehensive, lack of systematic research and lack of operability in specific practical links. How to protect the intangible spiritual rights and interests of the law needs to be explored and studied. It is precisely because of this level of theoretical and practical value that the significance of this topic. This paper deeply analyzes the problem of spiritual support, analyzes the present situation and current legal provisions of spiritual support in our country, and refers to the advanced legislative theory and practical experience of foreign countries, combining with the national conditions of our country. Some suggestions are put forward to improve the legal protection of spiritual support.
