人格权商品化法律问题研究

【摘要】： 随着现代科学技术的发展、市场经济的繁荣与新闻传媒的发达,人格权开始具有更多、更直接的经济利益,越来越多的被商业利用,人格权经济利益的实现已经成为一种发展趋势,传统民法对人格权经济利益的保护已陷入僵化困境,在这种背景下,研究人格权经济利益的保护具有非常重要的理论意义和实践意义。各国从其既有的民事权利体系出发,发展出不同的人格权保护模式,以美国的公开权和德国的人格权商品化为主要代表。本文在对揭示人格权经济利益凸显及其保护进行合理性分析的基础上,对美国、德国的人格权保护进行了比较分析,并结合我国的法律制度,说明我国应选择人格权商品化模式的理由,并就完善我国人格权制度提出自己的建议和意见。
[Abstract]:With the development of modern science and technology, the prosperity of market economy and the development of news media, personality rights begin to have more and more direct economic benefits, and more are used by commerce. The realization of economic interests of personality rights has become a trend of development. The protection of economic interests of personality rights by traditional civil law has fallen into a rigid predicament. It is of great theoretical and practical significance to study the protection of economic interests of personality right. Based on the existing civil rights system, various countries have developed different protection models of personality rights, mainly represented by the commercialization of public rights in the United States and the commercialization of personality rights in Germany. On the basis of analyzing the rationality of revealing the prominent economic interests of personality right and its protection, this paper makes a comparative analysis of the protection of personality right in the United States and Germany, and combines the legal system of our country. This paper explains the reasons why our country should choose the mode of commoditization of personality right, and puts forward its own suggestions and opinions on perfecting the system of personality right in our country.
