多哥共和国海上货物运输承运人责任制度研究

本文研究多哥共和国海上货物运输法的承运人责任制度。由于多哥共和国已经批准了《鹿特丹规则》,并将其纳入有关海上货物运输的国内立法,即《新商船海运法》中,故本文主要讨论《鹿特丹规则》下的承运人责任制度。本文介绍了多哥共和国海上货物运输法从颁布批准《鹿特丹规则》的发展过程,通过对《鹿特丹规则》与英国法、中国法进行比较的方法,阐述了海上货物运输承运人的主要义务与责任。第一章是关于本文研究的—些基本问题,介绍了从研究背景、目的到包括研究方法和资料在内的承运人责任问题的完整体系。值得注意的是,本文的研究目的是考察多哥立法中承运人责任制度的由来以及《鹿特丹规则》中承运人责任制度的主要特征。本章还介绍了本文研究的主要问题,综述了多哥文献和国际文献中有关海上货物运输承运人责任制度的主要观点。第二章是关于多哥立法下承运人赔偿责任制度的演变。作为研究的基础,系统梳理了从多哥共和国独立前直至批准《鹿特丹规则》期间,通过和适用的有关海上运输的国内立法,尤其是海上货物运输法,即《新商船海运法》。本章按时间顺序论及了批准《鹿特丹规则》之前的所有现行立法,并解释了通过《新商船海运法》时遇到的困难。第三章分析了海上货物...
