【摘要】：清朝养廉银制度是在雍正时期推行的一项政策,以此来改变官员俸禄低、吏治腐败的现象。通过给官员发放高于正俸几倍甚至几十倍的养廉银两让官员专心于政务、维护地方的稳定。通过养廉银立法的实施,朝廷内外得以清明、巩固了政权,取得很好的效果。但是,随着养廉银制度实施的不断深入,其存在的弊端也渐渐显露出来,在乾隆后期甚至导致更严重的腐败,养廉银并不能养廉。本文的研究从引言入手,对养廉银立法的研究主要包括三大部分,首先介绍了养廉银的立法背景,背景的研究主要围绕政治背景、思想背景、制度背景、社会背景这四个大方向展开。养廉银立法是清朝特殊历史背景条件下的产物,因此深入研究养廉银立法背景有助于我们全方位了解养廉银制度的精神。其次本文主要研究的是养廉银立法的内容,这是本文研究的重点。财政基础和支取制度这两个方面是养廉银立法的主要内容,其中财政基础主要介绍的是耗羡归公制度。因为耗羡归公制度是养廉银最主要的财政来源,包括耗羡归公的原则、比率标准、范围以及用途等几个方面的内容。养廉银的支取制度主要围绕养廉银发放的原则、对象、数额进行研究,力求对养廉银的内容有一个详细、全面的介绍。最后,本文的研究主要围绕两个方面展开,一是养廉银立法的实施效果,二是对当代的启示。养廉银立法实施的效果包括积极效果以及存在的弊端,养廉银立法实施的弊端是本文研究的重点,通过分析其存在的弊端才能更好地为当代所用。养廉银立法实施的启示是把清朝养廉银与当代反腐相结合,以史为鉴,通过全面分析养廉银立法更好地为当代服务,以期为当代反腐做出一定的贡献。

Secondly, this paper mainly studies the content of legislation. This is the focus of this study. The financial basis and the withdrawal system are the main contents of the legislation. The disadvantages of the legislation implementation is the focus of this study, through the analysis of its shortcomings, it can be better used for the contemporary. The enlightenment of the legislation implementation is to combine the Qing Dynasty with the contemporary anti-corruption. Taking history as a mirror, we can make a contribution to anti-corruption by analyzing the legislation of Lian Lian Bank.
