道德治理在食品安全规制中的价值思考

【摘要】：民以食为天,食以安为先。食品安全关乎民众的生命安危,关系社会的和谐稳定。频发的食品安全问题屡屡突破社会道德底线,保障食品安全既要“法者禁于已然之后”,更要“礼者禁于将然之前”。道德治理作为一种特殊的治理方式,其对于个体的导向、教育、平衡功能在食品安全规制中有着重要的作用和价值,有助于食品安全规制的门闸前移,从根源上解决食品安全问题,促进个体积极化外在的法律法规道德价值理念为内在的、自主的品行操守,提升食品安全规制的规范性与柔韧性。在介入食品安全规制的过程中,道德治理积累了较为丰富的经验,取得了一些积极的成效,但也存在制约其继续突破与发展的困境。因此要最大限度发挥道德治理在食品安全规制的价值,需要认清困境背后的深层次原因,并在此基础上探索道德治理价值实现的优化路径,推进食品安全领域道德治理的规范化、科学化和时代化。
[Abstract]:The people take food as the day, and food takes peace as the first. Food safety is related to the lives of the people and the harmony and stability of the society. The frequent problem of food safety breaks through the bottom line of social morality. To ensure food safety, we should not only "ban the law after the law", but also "ban the ceremony before it will." As a special way of governance, moral governance plays an important role and value in the regulation of food safety, and helps to move forward the gate gate of food safety regulation. To solve the food safety problem from the root, to promote the individual to actively turn the external law and regulation moral value idea into the internal, independent conduct, and to enhance the standardization and flexibility of food safety regulation. In the process of intervening in food safety regulation, moral governance has accumulated rich experience and achieved some positive results, but it also has the dilemma of restricting its breakthrough and development. Therefore, in order to maximize the value of moral governance in food safety regulation, it is necessary to recognize the deep-seated reasons behind the dilemma and explore the optimal path to realize the value of moral governance. To promote the standardization, scientific and contemporary of moral governance in the field of food safety.
