服刑人员法律信仰重建问题研究

【摘要】：近年来,随着经济水平的快速发展,我国的国际社会地位不断提高。为最大限度的保障国家长治久安和维护人民基本权益,党和国家提出依法治国、构建和谐社会。特别是十八大四中全会以来,党和国家把依法治国理念推向全新的高度,建立和完善法律体系,增强全民法治理念,得到人民群众广泛支持。尤其是对某些特殊人群,如服刑人员、受过刑事处罚的人的人权保障取得了较大的进步。但由于社会处于高度转型之中,各种矛盾突出,道德缺失、信仰迷失现象较为凸显。尤其是法律信仰的缺失对我国社会经济发展产生了一些不稳定因素,建立和完善司法体制,构建现代法治精神,重建法律信仰迫在眉睫。本文就正在接受刑事处罚的特殊人群为研究对象,展开对服刑人员法律信仰重建问题的研究。对服刑人员法律信仰重建存在的价值背景,法律信仰重建的发展现状,法律信仰重建存在的困境等展开重点分析。通过对服刑人员法律信仰重建的过程的中有关机制,以及对影响服刑人员法律信仰重建因素的具体分析。分析法律信仰重建过程中的动力机制、教育机制、以及法律信仰重建过程中的交流机制的现象本质。对影响服刑人员法律信仰重建的因素进行逐一探究,针对其服刑人员法律重建影响因素释放对策,从而找到适合服刑人员法律信仰重建的方法。以提高服刑人员的法律信仰,融入并适应不断变化的社会环境,对于提高我国服刑人员改造效果,降低再犯罪率具有重要而深远的意义。
[Abstract]:In recent years, with the rapid development of economic level, China's international social status has been improved. In order to ensure the long-term stability of the country and safeguard the basic rights and interests of the people, the Party and the country put forward to rule the country according to law and build a harmonious society. In particular, since the fourth Plenary session of the 18th CPC Central Committee, the party and state have pushed the concept of governing the country according to law to a new height, established and improved the legal system, and strengthened the concept of the rule of law by the whole people, which has been widely supported by the people. Especially for some special people, such as prisoners, the human rights protection of criminal punishment has made great progress. However, because the society is in a high transition, various contradictions stand out, moral deficiency, the phenomenon of loss of faith is more prominent. Especially, the lack of legal belief has produced some unstable factors for the social and economic development of our country. It is urgent to establish and perfect the judicial system, to construct the spirit of modern rule of law and to rebuild the legal belief. In this paper, the special people who are receiving criminal punishment as the research object, starting to study the reconstruction of the legal beliefs of the prisoners. This paper focuses on the value background of the reconstruction of the legal belief of the prisoners, the present situation of the reconstruction of the legal belief, the predicament of the reconstruction of the legal belief, and so on. Through the relevant mechanism of the reconstruction process of the legal belief of the prisoners and the concrete analysis of the factors affecting the reconstruction of the legal beliefs of the prisoners. This paper analyzes the dynamic mechanism, the educational mechanism and the phenomenon essence of the communication mechanism in the process of legal belief reconstruction. This paper probes into the factors that affect the reconstruction of the legal beliefs of the prisoners one by one, and aims at the releasing countermeasures of the influencing factors of the legal reconstruction of the prisoners, so as to find a suitable method for the reconstruction of the legal beliefs of the prisoners. It is of great significance to improve the legal belief of the prisoners, to integrate and adapt to the changing social environment, to improve the reform effect of the prisoners in our country and to reduce the recidivism rate.
