中国古代“契族”法律文书名词研究

【摘要】：我国古代有大量的民间“契族”法律文书留世,相应的“契族”法律文书名词也伴随产生。“契族”法律文书名词是指契约双方在基层社会生活中发生一定权力义务关系时,为保证订立双方的利益,制定相应的规则而形成的一种文书名词,具有相应的法律意义,诸如契约、书契等。“契族”法律文书是在各种社会活动中直接产生的原始文字资料,生动真实地记载了各个历史时期社会经济、政治、文化和法律等方面的发展状况,具有原始性、真实性和唯一性,是当时社会发展、民间百姓日常生活的重要再现,作为非常珍贵的历史文献、历史档案,具有重要的研究价值和现实意义,由此“契族”法律文书名词的意义也就不言而喻。自20世纪80年代起,大量的“契族”法律文书被发现,其价值也日渐受到重视。各地区都有“契族”法律文书得以集中刊布并按照一定原则编辑汇编并校审出版,但并未有学者对“契族”法律文书中的“契族”法律文书名词进行系统性的梳理分析,本文的研究以原始“契族”史料为主,以现出版发行的“契族”法律文书汇编做为补充,对其中所涉及的一些重要或常见的“契族”法律文书名词进行分类整理、系统归纳,分析探讨其出现的最初背景、形成的整体过程、应用领域等。本文对中国古代“契族”法律文书名词的研究主要从“契族”法律文书名词的产生朝代、最初含义入手,分析其在各个朝代的发展特点、具体“契族”法律文书名词类别及基本含义、法律文书名词的应用及意义三方面进行,具体结构分为三部分:第一部分“契族”法律文书名词的来源、基本构成特点;第二部分为各个时期“契族”法律文书名词在各个朝代发展的基本构成特点;第三部分对中国古代“契族”法律文书名词进行系统分类,并对一些具有标志性的“契族”文书名词进行详细论述。总之,本文是利用历史文献学、语言学等的相关理论,在整体上继承了前人对于文档名词研究方法,对现有可统计到的古代“契族”法律文书中所涉及的古代“契族”文书名词进行的系统性、深入性汇总研究,具有重要的学术研究价值。
[Abstract]:In ancient China, a large number of the legal documents of the folk "clan" were left to the world, and the corresponding nouns of the legal documents of the "deed nationality" were accompanied by the law. The term of the legal documents of the "Qi clan" refers to a kind of document formed by the two parties in order to ensure the benefit of the two parties and formulate the corresponding rules when the parties have a certain power and obligation in the social life of the grass-roots level. Nouns have corresponding legal meanings, such as contracts, books and so on. The legal documents of "the deed clan" are original text materials produced directly in various social activities, vividly and vividly record the development of social economy, politics, culture and law in various historical periods, which are primitive, true and unique, and are the society of that time. Development, the important reappearance of the daily life of the people, as a very precious historical document, historical archives, has important research value and practical significance. Thus, the meaning of the nouns of the "deed" legal documents is self-evident. Since 1980s, a large number of the law documents of the "clan" have been found, and their value has been paid more and more attention. In all regions, the law documents of the "Chi nationality" are published and compiled and compiled in accordance with certain principles. But there is no systematic analysis of the terms of the "Chi nationality" in the legal documents of the "Chi nationality". As a supplement to the compilation of legal documents, some important or common nouns of the "Chi nationality" legal documents involved are classified, systematically summed up, analyzed and discussed the original background, the whole process of formation, the application field and so on. The original meaning of the nouns of legal documents begins with the original meaning, analyzes its development characteristics in various dynasties, the category and basic meaning of the nouns of the legal documents, the application and significance of the legal document nouns in three aspects, and the concrete structure is divided into three parts: the first part is the source of the nouns of the legal documents of the "Qi clan". The second part is the basic constitution characteristics of the legal document nouns of the "Qi clan" in each period. The third part systematically classifications of the nouns of the legal documents of the ancient Chinese "Qi nationality", and gives a detailed description of the nouns of the iconic "clan" documents. In a word, this article is the use of historical documentation and language. On the whole, the theories of learning and so on inherit the predecessors' methods of research on the document nouns, and systematicness and in-depth summary of the ancient "deed clan" nouns involved in the existing ancient "Qi clan" legal documents, which have important academic research value.
