中国当代法律文书名词三大基本来源及其应用

【摘要】：本文的研究范畴是当代的法律文书名词,即指从自1949年新中国建立至今。本文所研究的法律文书名词是指按照当代学者对法律文书的范畴划定的基础上进行的名词研究。本文对当代法律文书名词的三大基本来源分别进行溯源研究,本文对法学、语言学、文书学和档案学都有一定的意义。三大基本来源包括传统继承、西方移植和当代自创。其中传统继承又分为古代和近代两个方面,西方移植又包括近代移植和当代移植两个方面。本文主要分为四个部分,其中除了第一部分是对当代法律文书名词的发展概述的介绍以外,其余三部分就是按照渠道划分。每一部分先介绍对法律文书名词进行的溯源,然后论述词语产生之后,在其他历史阶段的应用情况。
[Abstract]:The scope of this study is a contemporary term for legal documents, that is, from the founding of New China in 1949 to the present. The legal documents nouns studied in this paper refer to the noun research based on the classification of legal documents by contemporary scholars. This paper studies the three basic sources of contemporary legal clerical nouns, which are of significance to law, linguistics, clerical science and archival science. The three basic sources include traditional inheritance, Western transplantation and contemporary self-creation. Traditional inheritance is divided into ancient and modern aspects, and Western transplantation includes modern transplantation and contemporary transplantation. This paper is divided into four parts, except for the introduction of the development of contemporary legal documents in the first part, the other three parts are divided according to channels. Each part first introduces the origin of legal documents nouns, and then discusses the application of words in other historical stages.
