民事诉讼书及判决书的汉维翻译研究

【摘要】：十八大提出“全面推进依法治国”,第二次中央新疆工作座谈会也提出依法治疆、团结稳疆、长期建疆的总体战略,这意味着我国未来要重点建设法制社会,形成“法治体系”。新疆是多民族、多宗教、多元文化地区,在新形势下,推进依法治疆、普及法律知识,依法执政,公检法单位首当其冲。我国宪法第一百三十四条和刑事诉讼法第九条中均有相关条例规定:少数民族公民享有使用自身民族语言文字的权利以及当事人享有法庭翻译的权利。随着我国法治社会的逐步建设,人民大众的法律思维意识都在进一步的加强,但是在新疆仍然有部分公民不善于运用法律来维护自己的合法权益。在这样的大环境下,专业地对法律文书进行翻译就变得非常重要,法律文书在翻译的内容及方法上对其准确性的要求也显得更为迫切和必要。法律用语翻译是法律文书翻译的核心。本文以收集到可公开的171份民事诉讼书及民事判决书的汉维翻译文本为研究对象,通过文献研究法、材料分析法、个案研究法、比较法、理论与实际相结合法等多种研究方法,研究民事诉讼书及民事判决书的汉维互译,从其翻译特点和翻译原则着手,分析在翻译民事诉讼书及民事判决书时所需的翻译方法、注意事项以及其互译过程中所存在的一些问题,总结出法律用语在民事诉讼书及民事判决书汉维互译过程中可能出现的错误倾向以及对其的预防机制,目的是使汉语法律文书下的维吾尔语翻译更加准确,为法律用语汉维翻译研究的规范化提供一些帮助。同时推进法学研究和法学教育,推动全社会形成遵法、学法、守法和用法的良好氛围,推进以法治疆战略,促进新疆社会稳定和长治久安。
[Abstract]:The 18th National Congress put forward the general strategy of "comprehensively promoting the rule of law" and the second Central working Symposium on Xinjiang work also put forward the overall strategy of administering Xinjiang according to law, uniting and stabilizing Xinjiang, and building Xinjiang for a long time, which means that China should focus on building a legal society in the future. Form a "system of rule of law". Xinjiang is a multi-ethnic, multi-religious, multicultural region. Under the new situation, the public security bureau, procuratorate and court units bear the brunt of promoting the administration of Xinjiang according to law, popularizing legal knowledge and ruling the country according to law. Article 134 of the Constitution of our country and Article 9 of the Criminal procedure Law contain relevant regulations: the citizens of ethnic minorities shall have the right to use their own national languages and the parties concerned shall have the right to be translated by the courts. With the gradual construction of the society ruled by law in China, the people's legal thinking consciousness has been further strengthened, but in Xinjiang, some citizens are still not good at using the law to protect their legitimate rights and interests. Under such circumstances, it is very important to translate legal documents professionally. It is also more urgent and necessary for legal documents to require the accuracy of their translation in terms of their contents and methods. Translation of legal terms is the core of translation of legal documents. This paper focuses on the Chinese-Uyghur translation of 171 open civil litigation documents and civil judgments, and uses the methods of literature research, material analysis, case study, comparative law, combination of theory and practice, and so on. This paper studies the translation between Chinese and Uyghur of civil litigation documents and civil judgments, and analyzes the translation methods needed in translating civil litigation documents and civil judgments from its translation characteristics and translation principles, and analyzes the translation methods required for the translation of civil litigation documents and civil judgments. The points for attention and some problems in the process of translating them into each other summarize the possible erroneous tendencies of legal terms in the process of translation of civil litigation documents and civil judgments between Chinese and Uyghur and the preventive mechanisms for them. The aim is to make Uighur translation more accurate under Chinese legal documents and to provide some help for the standardization of Chinese-Uyghur translation studies of legal terms. At the same time, we should promote the study of law and the education of law, promote the formation of a good atmosphere of law-abiding, law-abiding and usage in the whole society, promote the strategy of ruling Xinjiang by law, and promote social stability and long-term stability in Xinjiang.
